I think running a company in a insolvent status is not legal in many countries. Is that legal in the US? Is Cryptsy based in the US?

No one in his right mind believes what Cryptsy is saying. It's more than clear what they did. It's basically a second Mark Karpeles situation. The owners will eventually get away with it, and enjoy life with the stolen coins, and the customers are in a heavy loss.
