Current state does not say anywhere that bitcoin is legal or illegal. Its investors who is considering it as legal. Nowhere RBI has stated that its is legal. But yes I agree media cannot make it legal or illegal but they do have an important role since they make the people perceive as they want it whether its good or bad which is again risky.


uhhh, everything is legal until there is a law passed against it making it illegal.  that is how the legal system works.

is there a law making crypto currency illegal in India as of today? NO.

AS OF NOW BITCOIN AND CRYPTO-CURRENCIES ARE LEGAL IN INDIA.

the Gov't may decide to ban it tomorrow, or in 6 months, or in 2 years, (carpet ban is highly unlikely, regulated use and tax laws are likely to be created) but as of today, they are legal. if you disagree, please re-examine your understanding of the modern legal system. as a community, Indian bitcoiners should rather showcase the positive aspects of crypto-currencies. we need more positive media coverage.  instead our media only chooses to focus on drug dealers from Mumbai and Hyderabad buying lots of cocaine and LSD from the DNMs using BTC. This news is totally contrary to the below discussion. Well as per this news bitcoin may get banned in India in coming time and as per below link they are considering to make it legal. This is so very confusing whether to consider it legal or illegal in coming time?

Currently it is legal.

Until a court order is passed, it is legal.

Speculation and news articles do not make it illegal.

Whats the status now? I always thought that they would treat crypto as another asset class and tax it accordingly. Banning it altogether is an extreme view.

The Supreme Court has asked the Reserve Bank of India to look into the complaint seeking its intervention to take urgent steps for restraining the sale and purchase of illegal crypto currencies or “Virtual Currency” (VCs), like Bitcoins, which are being traded openly and extensively within the knowledge and domain of the RBI.

A Bench of Chief Justice J.S. Khehar and Justice D.Y. Chandrachud disposed of a writ petition filed by Vijay Pal Dalmia and Siddharth Dalmia, experts in internet technology on Saturday highlighting the consequences of unrestrained use of Bitcoins for a host of anti-national, illegal and nefarious activities, such as funding of terrorism and insurgency, illicit trade of arms and drugs, recruitment of terrorists, bribery, corruption and money laundering.

Mr Vijay who argued in person informed the court about tax evasion, generation of black money, payment of ransom, human trafficking and prostitution, transfer of money through hawala, hawala trade and etc.
