If a person breaks the rules a lot (e.g. by repeatedly spamming) or in a particularly egregious way (e.g. by copy-pasting or by posting malware) and gets banned they can still go and do that shit elsewhere, in places that allow spamming, plagiarism, malware, etc.
Scams are not moderated and while that's counter-intuitive to many, it allows moderators to be more impartial and the community to label scams via the trust system.

A scammer doesn’t care about his account and the quality of posts, only profit is important to him. And the ban of his account is only a financial loss.
