I have ordered 2 Antminer L3+ shipment reached on 7 September.  it was hold by the delhi   UPS said that this shipment can't be cleared neither in courier mode nor in cargo mode but I have tried and hired a agent he told me that DC is making issue.. than I reach to the Delhi customs and met DC she is very polite and knows about mining rigs and she's in our support but the other officers are making the issue. they are saying this cannot be in personal use or research purpose etc. finally I lose all the hope.. than in January  I got a call from my agent He told now you can proceed to pay the duty amount or IEC code penalty etc. finally somehow IT WAS  CLEARED BY THE CUSTOM. NOTE: THIS IS NOT  RESTRICTED AND RBI  JUST GIVE A ADVISORY warning its not a rule... THERE  IS NO GOVERNMENT ORDER TO RESTRICT MINER

The best thing to do will be to start video recording and asking them to tell on camera that it is a RBI rule or the government has forbidden it. SM sharing and spreading awareness will help.

dude already updated(first post), it was cleared but for new orders, bitmain sends a refund email or they will hold shipments until they get a clarity about the Indian govt policy.

From this event can me start making a assumption that government is not in a mood to make it legalize due to which they have asked to restrict any such items related to bitcoin. Or shall we consider there is still a scope and once the government clears the path this shall be cleared? From recent past news its getting  from good to little bad shape for bitcoins in country.

This is regarding  Nationwide blockage by customs clearance for Antminers in India.   All antminers (High speed ASICS  HSN CODE: 85437099) imported from china to India after August 20th are blocked by Indian customs. As we did not know about the change of RBI guidelines towards Antminers all shipments are blocked now with the Indian Customs.

They would need enough power supplies to run such a scam and power supplies usually get cleared without any problems. It is just incompetence and arrogance of officials who think they can do whatever they want, when most of their job duties can be done with the help of a single 25 dollar Raspberry Pi.  I emailed RBI about any new notification(no reply) and also launched a grievance on  https://www.pgportal.gov.in/GrievanceNew.aspx .I suggest people launch grievances on this and select CBEC after Public. If many do may be something will come of it.

As per the UPS guy, the District Commissioner (Customs) has been directed by RBI to not allow any further shipments of bitcoin mining equipment, until further notice, due to concerns that these could be used to fund illegal activities such as terrorism. The DC is basically saying " get an approval letter from RBI and i will clear it". So it guess its going to be a loooooooong wait till we get shipments cleared, by which time the profitability of using the miner will go down massively, to the point that it becomes an expensive paperweight!.

IMO it is absolutely ridiculous, and geared towards making life as difficult as possible for miners in India, with everything getting taxed to the maximum possible extent for an "acche din" that never shows up on the horizon.



They are making life a hell and that is the only thing they are good at.

The Reserve Bank of India had cautioned the users, holders and traders of Virtual Currencies (VCs), including Bitcoins, about the potential financial, operational, legal, customer protection and security related risks that they are exposing themselves to, vide its press release dated December 24, 2013.
The Reserve Bank of India advises that it has not given any licence / authorisation to any entity / company to operate such schemes or deal with Bitcoin or any virtual currency. As such, any user, holder, investor, trader, etc. dealing with Virtual Currencies will be doing so at their own risk.

It even says users are responsible for their own. They are causing a lot of tension asking for this and that document. Indian government just finding new ways of harassing its citizens.

I just called UPS asking for Query written by customs which asks for NOC from RBI.. And than the voice stumbled which gave me a hint that UPS is playing around. I said if you need NOC give me the copy of query which I can show to RBI and get a NOC.. Also, I spoke to a big clearing agent who told me that RBIs NOC is only needed to show that you have paid from your earned money not for anything else. So, now UPS says we will try to get it cleared on your request (without NOC). Lets see what happens..

Happening with me too, got my PSUs delivered however for D3s UPS is asking for NOC from RBI.. I am shocked of the scam they are running.. i have told them that it has to do nothing with RBI, UPS says its dash coin miner, I said how do you know.. there is no place where its written that.. I have written a letter to them on email stating that its a high end graphic card required nothing to do with RBI!!

As per some folks RBI has asked customs to not clear crypto currency related H/W. And some are saying they need permission from RBI to issue the clearance. Meanwhile we people are are not just losing money on the crypto we could have mined, we will also be paying customs for holding our shipments that is in addition to 40% plus tax.

"Re-imbursement charges INR 250.00 or 2.5% of the duty amount whichever is higher along with Demurrage charges (as per below table) +service tax.

From 0-3 days                              :  0

From 4-10 days                            :  (Rs. 2 per kg/day)

From 11-20 days                          :  (Rs. 3 per kg/day)

From 21-30 days                          :   (Rs. 4.5 per kg/day)

From >30 days                             :   (Rs. 6 per kg/day)

Please note that according to the provisions under the Regulation 5(5) of Courier Import and Export (Clearance) Regulation, 1998 as amended vide Customs Notification No. 54/99, the shipment may be surrendered to the customs for disposal, if not cleared within 30 days of arrival."

Yes we are paying first world taxes in a third world country. Actually some of first world countries don't charge anything for this and others charge 5-12%. Besides paying import duty on a hardware your country doesn't produce is stupid and regressive.

Sad state of governance.

At least miners are not having to pay double tax like imported vehicles.
I just hope rahul gandhi imports some miners and finally raises enough capital to fight Modi and win an election and reduce these ridiculous prices.

It is not the weight. They just said Bitcoin Miners are restricted in courier mode.

They will give me an update in 2-3 days

For anyone else wondering about the import duty in India  on Antminer S9, it is IGST 28% + BCD 10% + Cess 1% as of September 2017. So they are charging Rs 32027 around 42 % tax.
USD 1099 + freight charges of USD 74.18 = USD 1173.18
1173.18*64.90= Rs 76139

Well today they said Shipment landed in courier mode and asked me to share another declaration letter addressing to “Deputy Commissioner of Customs”, NCT, New Delhi, requesting customs for clearance and also asked to state end use, purpose of import of the imported article, (will update as it goes )

Well have you asked them why it cannot be imported in courier mode??

as per cbec" Packages upto 70 Kgs. of weight can be imported to India through courier mode. However, there is no such weight limit for export of goods through courier from India."

Also  "Commercial goods which are dutiable can also be imported through the courier without any restriction of quantity subject to payment of duty by the courier company at the time of clearance of the said goods from the Customs. "

No need to sit on the fence. Sit on a chair. You can always use fedex, dpd or Dhl. They have no such issues.

I also thought the same. Didn't have problems before. Will never use UPS again.

First clear out the current issue and provide more updates.

Have you tried calling UPS office in India and asking them what they can do about it other than sending it back? Maybe its an internal policy within UPS to not clear it, and maybe they can give you the documents necessary to transfer their responsibility to you and you take up the burden of customs clearance? I think anything would be a better solution than having it sent back.
