No, but based on some research I've done independently and gave to theymos last year, I find it very likely he has passed. He had a few real-life accounts that have gone essentially unused since the time he supposedly died. I've checked in on them occasionally and they are still unused.

2) Why do you type another THREE line breaks to sign every message? We know who is writing the message because of the user info which magically appears alongside posts.
3) At what point does it become meaningful? 500? 1000? 2500 BTC? All of it is money which could be used for one thing or another.

I'm sure Sirius, justmoon and all the donators, and not to mention the IRS, will be interested to see it.
1) The forum files and pays taxes
2) The forum itself is not a registered company [that I've seen], and so has to be owned by an individual - it doesn't exist as an entity on its own.
I would like to ask one major question. Why in the hell are so many people worried about 250BTC that was property of the forum? The 250BTC is meaningless to the forum, how it is ran or even in the development of the new forum. That 250BTC will never impact your current user experience or any in the future. Again, why are so many people worried about that 250BTC?

I will follow this with several other subpoenas to investigate the actions that are being carried out. Some of these subpoenas will involve the forums money being used for the forum software.

How much time has passed since his death?
Obviously, even if he intends to recover it he should wait a good period of time.
Waiting for the appropriate time is the right thing to do, before recovering the money(if that is his intention).

So I'm surprised theymos hasn't got it back, obviously if someone was stealing the money it would have moved, so I'd assume the family just need to be contacted to see if they can find the wallet.
