but when I AM able to have it, is it allowed to take an image from the internet and use it? Suppose it is not stated the image is copyrighted anywhere. What if anything should I be aware of and make sure of? I just don't want to do anything stupid.

You're not going to get into trouble from the staff here unless it's NSFW or something, but if you use a copyrighted image of Justin Bieber as your avatar don't complain to us when the feds kick down your door and take away your hard drives.
