I haven't been following, but is there any progress on the new forum software and will it include anything to improve these problems with reputation and moderation?

Other, modern forum software solves this through a variety of methods, least of which is "reputation"... lacking any modern features on SMF, we are left with basically the most barebones of message forums in existence and we are stuck with "moderation" that is straight out of the 1990's.
Don't expect any improvements until the base of the community is improved and improvements can be built on that. Right now, you can't build anything on what we have here.

Does it seem like at times that certain members of this community are protected?
I would imagine that Theymos is protected haha. But other than that, definitely people are protected...at least from the little stuff. You'd have to reallllyyyy mess up as a mod/admin/"super user" to fall into the scammer category.
It's indeed just a forum, but it would be awkward, if business sections was not fair. Ideally it should be as neutral (6 confirmations?

It should be neutral, but its not. It must be a free for all, without censorship. Scammer tags are wrong, yes its nice to know who did the scamming...but let the one who got scammed explain the situation. we have otc to look at how happy people were in their businesses, but the moderators here are not court appointed judges...they may choose one person over another...

No would SHOULD be anything lol, just cause you are own a business or service does not give you more rights "Hence 1% cries and all that crap". Everyone should have the same rights, the same DUE PROCESS. I have suggested this before and I think it still needs to be done a credit rating system for people and business on Bitcoin, and not a 2 starfish rating either. A real rating with complaint submits and investigations. How one is rated should be published with a how many complaints filled how many solved, If someone refuses to solved the problem in X amount of time then the Score is tacked and the complaint is a Mark on there record for X amount of years. I started a system like this a while ago but everyone went to Patricks, which just rated borrowers.
Some people SHOULD be protected, otherwise attention whores will just make hell for the legitimate operators of central services.
The only problem is this protection should be both flexible and sensible, which obviously in practice is a nightmare to achieve (not to mention the issue of inertia, takes a while for any arbiter to catch up with all the goings on).

I have my own forum, and for some reason people do not act like babies on it... most of us are sarcastic fuckers and can understand the jokes, but in the end we are all here for the same thing, name calling and foot stomping is something my children do...

It would be meaningless. Self-expression wouldn't be possible considering everyone would have to be perceived identically and growth would be non-existent.

Yes and no. I've seen with my own eyes someone get protected, and it delayed a scammer investigation for MONTHS. At the same time, though, I've personally thrown the book at some pretty big names in Bitcoin.

I'd much rather keep the flamewars from reaching critical mass, so i wont be dropping any names, but it seems like there are times when members of this community can get away with damn near anything without so much as a slap on the wrist while others get the book thrown at them near instantly.
Im not looking to pick a fight with any of the admins (or business/security owners), nor am i running a competing bitcoin forum, its just that the decision makers own interests seem to overlap whats best for the community as a whole.
