I said i dont need to send btc first for my order but we can talk to bitmain support and after they confirm to both of us that they changed the shipping address to your place you send me the bitcoins. Or we can use escrow but this guy asked me to send all my miners in advance to him then wait for him to sell them and after he sell them he is supposed to send me 90% of the price he selled them to. So i have to wait an undetermined time for him to sell at a price only he knows from what he will supposedly give me 90%. I politely turned him off.
You should pick an escrow from this list. The top 5 are the ones used most often and with some of the best reviews.

Batch5 was much more expensive  0.37 USD for GHs without shipping, than Batch7 or 8
Nobody wants to pay more than 1BTC GHs which currently offers Bitmain with batch 8.   0.326 USD for GHs without shipping

Thus, you will be a loss anyway.
I think that this 10%  was a good offer . Personally, I would do it may be for 30% , if I had to pay for them immediately.

They also had an agreement with some other guys and needed by 15 nov the miners. They already took their money back and ordered (an older batch) from someone else (who gave them a bigger price than mine actually but had them on stock) so i am already on loss. I managed to find a client for 2 miners and i might buy another 2 for myself so i am trying at least to get a partial refund and send fewer miners.

As others have stated, I doubt you would be able to get a refund, but you have options for avoiding the VAT.  You could send them to someone like me in the US who could resell them for a fee and recover most of your money, or you could have them delivered to a data center and mine yourself with them.

EDIT: He wants you to send BTC first for his order.

bottom of your order page u can change the shipping address. by doing this you can sell the miners to someone else n recoup the btc u paid. pm me if u are interested.

You really do need to talk to your "client".  I don't know the deal you had with them but find a fair thing to do such as paying for mining for all the day's between you said they would have the miners and when they actually do.  That is what bitmain does.... so not great but hopefully your customer agrees to it.   I don't know your selling terms your "client" might be able to pull out if you messed up on the dates.  That was not the "clients" fault... so I tend to be on the side of treat them nice and hopefully they want them.   If you are selling 25 miners you should have a selling contract.

But I do not expect bitmain to give refund for any reason.  To do it for one people would use you as example tell the end of time asking for refund.  So they will not do it.

You'll pay the postage 2 times and get back from Bitmain  the rest of the BTC.  Return shipping can be several times more expensive than sending to you!

This is the reason why I did not put in the  one order ever so much miners. Only 2-5 at a time .

Then, all orders will be declared separately. Even if they come in one day.

In My country is the sales tax  only 20%

I highly doubt they will do refunds now after what is going on with the difficulty spike lately. Looks like the difficulty will double very soon.

Just tell your buyers that its not your fault that its late and there are no refunds due to Bitmain policy.

If you are in a country you owe vat... I would guess yes they are going to make you pay for that before receiving them.  I'm not saying your situation does not suck it does. 

You might need to deal with your "client" and see if you can make a deal.   Or find a way to get the VAT money on short term loan from someone and sell enough miners that you can pay back people you borrowed for vat. (Be very careful though make sure you can pay them back I'm in no way saying get a loan if you are not sure you can pay back)

Yes but i dont know anyone in another country and cant trust a stranger on internet that he will give me the money. Why cant they nust refund me since they didnt even send yet. There would be no harm done and no headaches for anyone.

It would be nice but there is not a chance of them canceling it they do at least list it at bottom:

All sales are final. No refunds will be given. Defective machines can be repaired for free under the Bitmain warranty policy. After the warranty period, machines can be repaired for the cost of parts and labor.

The big reason on no refunds I think is BTC price if you could refund a lot that bought at 230 would want to refund before it shipped.   Also they want your money once they get it.  So never buy more then you can aford to lose in miners, have to be cautious when buying hardware you read it and really want it.

I believe that you can have them change the shipping destination, although you may have to pay some additional amount if it costs more - so you might be able to find a buyer who will effectively 'take over' your purchase.  It's a tricky proposition, but if Bitmain will switch the order over to another account, then it might be possible.  You also could consider working with someone you know in another, more favorable import country, get them delivered and sell them off one-sy two-sy - you'll get the best return this way.
Just so OP know, I tried that too. I even got american and chinese customers knowing it's easier for them this way. Was ignored completely as usual.

Thank you for your support but i still have time. If they wont cancel my order i will be left penniless and in debt (and i cant have a debt i already have a mortgage nobody will give me another credit) so most probably i will have to refuse the order. Lawyering up i dont think it would help they would simply ignore my lawyer too.
Yeah like I said I don't know what to do either.
But I would tell you not to count on 100% refund when they get miners back, if you decide to deny it (i dont think you will get this order cancelled, they dont give a shit about you or anyone so you will have to take it or deny it when it arrives). They probably will claim you will have to pay costs, tax, fees, opportunity loss etc etc. And of course take months to pay you.

let us (me, i dont think other miners will care about you, me or anyone else either) know how it goes

Hello. I made a mistake and bought for a client of mine 25 s7 batch 5 from bitmain thinking they will deliver in 2-5 working days or 2 weeks with delay. What i didnt see is that they deliver from 27 nov and i promised the miners by 15 nov and now my client has asked for his money back and with what i have left i cant even afford to pay the vat to deliver to my country. I have asked bitmain for a order cancelation and since they didnt deliver yet i thought that would be ok, no harm done but they only ignore me or tell me to wait patiently for the deliver (i tell them i wont be able to pay for the crazy 24% vat my country has and they tell me to wait patiently for the miners to be delivered wtf???). What can i do ? Has anyone gone through something like this with bitmain ?
Yes. First consider yourself lucky to only be robbed out of 24%. I am robbed 80% by the government mafia (brazil).
Bitmain will not do anything at all. You might wanna lawyer up since it's a big order.
I passed through the same thing as you, and even though I contacted them hours after the purchase and btc price dropped (batch 4, quoted in USD. Btc price drops they lose) which would mean big profit for them (well over 35%, I purchased when bitcoin was at $496 and got proof of it in case you dont believe my luck), they ignored it COMPLETELY. I contacted everyone possible at bitmain, just to be ignored. They don't care. In fact the order was shipped early today.
I'm fucked either way. I will have either have to get a loan at the bank, be fucked by the bank and then be robbed and fucked by the government or risk denying these products, having them sent back to bitmain (or seized by the government forever!) and to count on bitmain to refund me anything, to which I can guess will be very very very small if anything, knowing as bitmain is.

I am awaiting to be responded since SEPTEMBER. Not to mention the tons of emails, skype, private message etc

It's 3 am and I am up because of this. Can't sleep. I am considering to fight. Not gonna give my sweat to bitmain or government. To neither. I think the best thing we could do is perhaps unite and spread the word on how bitmain treats their customers however I think everyone already knows that (and still kisses their ass), thus the reason I havent even bothered so far...

Dealing with bitmain is an ordeal. People here kiss their ass even though bitmain screws them all because they see bitmain as the sole provider of their (overpriced and bugged) toys.
