Objectively seen I dont think you can sue BFL for anything, if they didnt promise a specific date or time. I also got screwed by talk of early shipping, but they clearly wrote that it was only predictions.

But then again, in America you can sue people for the most retarded reasons...

My Jalapeno shipped in Oct, I mined with it until end of January and offered it up on Ebay which some poor sap took for the BIN price of $300. (which reminds me, he never left me positive feedback on the super-fast shipping...)

Thats why I love second hand. Right now I buy all second hand Bitburner Fury miner for 10USD/GH. At least I get them after I paid the price.

If I remember it correctly, there was some news a few days ago that some people sued BFL already for their late-later-latest delivery of the hardware.

The Jalapeno I ordered does not even hash out 5 gh/s! It's actually only hashing out 2.5 gh/s. Does anyone have any idea why?

Me and a friend ordered a butterfly labs bitforce 25GH in January. It was shipped in November. Until now we have not hardware break even and have invested more then 1800$ in shipping, hosting and the machine itself. We have so far mined 0.90 BTC. I believe there are more people here who have been affected by this. Has any approach been done to sue Butterfly Labs for fraud? If not does anyone know how we can do this or wants to join us as a group. Please get in touch.

$1,800 / $13 = 138BTC.

I told people like you to buy bitcoin instead of ASIC's.  I explained why bitcoin ROI is all that matters.

You could have bought 138BTC with your $1,800 instead of sending it to BFL.  Instead you bought a machine that gave you 0.90BTC.

Hopefully everyone learns a lesson.  Only calculate Mining ROI in BTC, and if you do this, you will never buy ASICs, you will just buy bitcoin instead.
Easy as that. But simple calculation is obviously to hard for some ppl...

They guarantee a certain hash rate not that you will make an ROI.  This is a business decision that you made and unfortunately, you would have made 90x more just by buying and holding actual bitcoins.  Let this be a lesson to you.  Mining is almost never the best option and never will be.

There are a couple threads in the custom hardware forum.  Litigation would probably cost you more than you would recoup (don't plan on recouping lost earnings since that is 20/20 hindsite and usually thrown out in court).  As a BFL idiot myself (my fault for falling for their preorder scam - shame on me for the 1st order) I understand your anger, but chalk it up to a learning experience and recognize that there is evil in this world  Cheesy
