Well eveyrone who is willing to buy a cointerra machine just stop...
No replies no nothing... they promised refunds... and again nothing...
Scamming People.. not even afraid of lawsuits... Something big is behind it..

Do you have any facts to support this, or are you just trying to disrupt Cointerra's business?

I've been to Cointerra's office in Austin, and am here to report that there was an office. The office consisted of several rooms where people of the human persuasion where working. I witnessed a phone and other things commonly associated with a office. The people I spoke with spoke English.

That said, please stop trying to disrupt Cointerra's business.

Our legal department has provided the following:

“The company has defaulted on its secured notes. The Note Holders have senior, secured and, we believe, perfected liens on all of CoinTerra's assets, including servers. We have proposed a plan to the Note Holders. However, at this point we do not know how they are going to react to our proposal. The Note Holders are evaluating their options. Until this is resolved, CoinTerra will be unable to make further payments.”

What this means is that we cannot issue any payments to customers at this time. We will let you know if this situation changes or if there are any relevant new developments but, for now, we have no further information.

June 30, sent email requesting refund status.
Aug 6th (7 days later), "Laura" from support said they were "processing refunds" and I was "still on the list"

July 2nd Received "zendesk" email "assisting me with my refund process" offering the mining contract, requested refund and status.
July 2nd Received "notified our finance department" and "Richard" closed the ticket.  Requested refund and status

July 9th, got mailchimp email "CoinTerra Refund Status Update" which stated it was scheduled to be processed on 07/29/2014

Unbelivable the bad refund moral.

At least Cointerra are trying to get back to their customers, Cointerra Hosting/Cloud Hashing are not even responding to their customers.  4 Months I've been waiting for their hosting arm to process a refund, it's been 3 months since they've even bothered replying to my emails.

Bleh!
My refund check for my December batch order has cleared. It took a whole week of phone calls back and forth just to deposit the check in my Bank of America account, but it finally appears to be OK. Well, that's a start. It's not like I got compensation for them holding my funds for around 8 months, but it's a hell of a lot better than it could have gone.

I'm still working on getting the wire transfer that Terramine hosting promised me.

I wouldn't be surprised if there's a class action lawsuit that comes out of this yet, especially the false expectations, highly suspicious timing of hosting plan promotions, and failure to deliver what they promised with the Cointerra-Terramine Hosting arrangement.

The legal letter shouldn't cost you more than a few hundred dollar max.

Do you have any family or friends located in the United States? If you do have a family member or friend, than I suggest that you ask them to help you send a hardcopy refund request/demand. Email them the softcopy letter and ask them to print it out and then have them go to a US Postal Office and send the hardcopy letter to Ravi via Certified Mail.

Basically what this thread tells me is that to get your refund you must kick and scream very loudly to get noticed and your refund processed.  Anyone remaining silent and relying on Cointerra's "goodwill" is going to be burned as evidenced by the people who have been waiting much longer than you for a refund (and probably had their request in before yours).  Also how many days past the 4 week window did it take for you to receive your money?

The 'kick and scream' method has been marginally effective for a small percentage of Cointerra customers; however, I would not recommend the use of that method.

By the by, I'm not an attorney, but I played one in a college drama class. Therefore, the information provided does not constitute legal advice and moreover, I recommend that readers seek legal advice from an attorney, especially for those that are not knowledgeable in business/consumer protection laws, or no experience in the litigation process.

First of all, this posted message is mainly for readers that fall into May and June batches who have received the email from CoinTerra Support with the subject, "TerraMiner Early Shipping Notification." If you have received that email, than you have received clear supporting evidence of Cointerra's breach of contract and may possibly support misrepresentation as well.  Final specs of 1.6 GH/s hashing performance using 2100 watts power consumption versus advertised specs of 2.0 GH/S using 1600 watts are clear breach of contract. Furthermore, the change in product warranty from 3 months to only 1 month provide additional supporting evidence for breach of contract. The changes clearly relieves Cointerra from potentially significant liabilities/costs while the customers' liabilities/costs become increasingly onerous. No need to even expand on the things they did that may be considered misrepresentation. Any customers who encountered the above have the right to a full refund within a reasonable time with a caveat.  A reasonable time means seven working days from the day that the customer makes a formal request to Cointerra for cancellation and refund of the customer's paid order.  

Secondly, customers may receive a reply email regarding their refund request in which the company stipulates that the refund process may take 4 weeks (this may also mean that the process can take 6, 7, 8, or possibly 20 weeks since there's no set maximum date to complete the refund payment) and it is absolutely critical to clearly convey in your formal refund request that anything over seven workings days is "unacceptable." Those in the past who did not immediately respond to their +4 weeks refund processing stipulation with your strong/clear objection may be giving up your right to a quick refund since your silence may constitute as your assent/acceptance to their lengthy refund process.


Thirdly, U.S. Federal Consumer Laws trump all of the states' consumer laws. Check the FTC link listed below concerning refunds, "If the customer paid by cash, check, or money order, you must refund the correct amount by first class mail within seven working days after the order is cancelled." If your order has been fully paid, then you either paid by wire transfer which is the equivalent to cash, or you paid with bitcoins which means that you paid by check because you used Bitpay as a middleman to convert your BTCs to US dollars and then on your behalf, Bitpay sent Cointerra a check via electronic ACH. It would be helpful to include one or two paraphrase sentence(s) regarding the Federal Law that are apropos to your situation in addition to some verbiage about legal options/remedies through standard civil litigation if the refund is not sent in a reasonable time (i.e., 7 working days).

Lastly, you need to incorporate the above details into your formal cancellation and refund request (refund payment via wire transfer is highly recommended to avoid a bounced/non sufficient funds refund check). The cancellation and refund request must be a hardcopy written letter sent via US Postal Service Certified Mail and your emails to Cointerra simply supplements the mandatory Certified Mail hardcopy letters.

If the above done correctly, your refund payment should be completed in under 7 working days, assuming that the company is still solvent of course. However, the more refunds they quickly process going forward, it increases the risk (e.g., the possibility of insolvency) for the remaining customers not yet paid as they continue to patiently wait for their refund.  


For non U.S. customers, I recommend that you search on Craigslist for an inexpensive low level general business attorney located in the Austin, TX, area in order to draft a strong request/demand letter for you. This shouldn't cost you more than a few hundred dollars.

So, I saw a couple of these kinds of messages and was really hoping that Cointerra was just having a bad week, overwhelmed with this or that and was getting back on the ball. Unfortunately, that wasn't quite the case.

I sent them a refund request on 20 March - request number 15712. After a few emails back and forth (boy they were pretty good at responding to requests in a somewhat timely manner (1-2 days tops)), I finally settled on getting a check refund (instead of BTC like I would have preferred).

Several emails later I finally got a reply on April 16th stating:

I was really excited to be getting such great customer service, considering there were so many posts on here about issues. I was glad to see they had fixed stuff up. Unfortunately, thats the last email I've received from them, depsite having pinged them several times to ask for updates or if there were issues and I even asked for a "hey, we're busy, sorry" email, but that seemed to have no effect. I'm not entirely sure what I'm supposed to do at this point. I've run out of options that I can think of. Any ideas?

Basically what this thread tells me is that to get your refund you must kick and scream very loudly to get noticed and your refund processed.  Anyone remaining silent and relying on Cointerra's "goodwill" is going to be burned as evidenced by the people who have been waiting much longer than you for a refund (and probably had their request in before yours).  Also how many days past the 4 week window did it take for you to receive your money?

and it was just a tittle in the thread to get some attention... for bankruptcy etc... i didnt have evidence of that...only my story,and from other 10 people

No one suggested that you did not have the right to complain. Of course you did.

What you actually did though was post some lies: that Cointerra is bankrupt, that Cointerra is scamming people, and the ominous, "there's sommmmmeee thiiiiiiing biiiiiiiig" behind it. When, in reality none of that was true. Even in this post, you note that you saw "...people whining and crying over 0.001 deposits..." who was a) making deposits worth about 43 cents, b) accepting deposits worth about 43 cents, and c) was whinging about losing about 43 cents?

For someone who was happy to emptily threaten a lawsuit, you certainly put yourself in the position of being on the receiving end of one.

agreed, the title shows that the poster has little command of english and also doesnt know what bankrupted means.  ironically, if it were true, they wouldnt get a refund, whereas the fact that cointerra has actually sold thousands of the boxes means theyre luckily not in that position, and could (if it warrants it) refund anyone who hasnt got their miner yet.

i also suspect there are those that havnt taken delivery of their miners yet may be those who dont want to take the early delivery option of a 1.6 TH/s model and would rather wait extra time (weeks) for the 2.0 TH/s model, which in most cases means they havnt grasped the difficulty rises in bitcoin mining mean that waiting for pre-orders isnt an optimum strategy when you could have something almost as fast in terahash terms, much earlier....  (of course there are those who dont believe in bitcoin mining, and for them, there is no price at which they would buy any miner from any supplier, and theyd prefer to buy bitcoins instead.. and thats their perogative)

I don't think they're even close to being bankrupt since they've shipped 5000 units and are still able to sell new units so unless they're doing something really stupid with the money they should be able to afford all the refunds.

But refunds really do need to be processed more quickly, I've been waiting for over 4 weeks now as well and all I hear is that someone is going to talk to the finance people-is there some kind of cash crunch??  Either way, when you're owed 56K by a company and it's past their original estimated refund timeframe it's not a good feeling.  Lawsuits are indeed expensive though so unless you have a huge order or are just wealthy and bored you'd be better off complaining to the Attorney General down in Texas first, the BBB is going to be nearly useless in this kind of situation since membership is voluntary and it's a private organization with no real power, whereas if a lot of people start writing to the Attorney General that a company owes them hundreds of thousands of dollars they'd start investigating what's going on, which would result mostly in time and costs on Cointerra's end to deal with talking with the AG without costing you who knows what in legal fees.

That said, if it's only a little over 4 weeks maybe you can still give them a chance to refund you soon, but threatening a lawsuit over a single unit isn't really very believable-if you lived in the US it'd be easier to file something in small claims or something, but even then it's a pain to collect.

Bitcoin mining is NOT a secure investment. This is NOT something you risk your children's welfare on. You didn't take a "risk". You took a major GAMBLE. $7000 is A LOT of money. How did you imagine this working out? Do you even realize how long it would have taken to get a return on your investment (if EVER)?

I really do feel sorry that you lost out here but there is no justifying this type of wreckless spending. Saying someone doesn't understand because they are "a man, from a rich country, who will never have to worry about anything" is an incredibly ignorant statement.
I agreed. However, CoinTerra have not processed all the refund requests there were supposed to take only up to 4 weeks. I only know one customer who received his refund. I'm not sure if CoinTerra going to file bankruptcy protection but Pre-order is always risky business. I have give where credit it due and CoinTerra did come through with shipping the miners. I've asked for refund myself due to power consumption on the final product and the noise. I live in a small apartment (flat) in NY and only have 40 Amp service to my apartment. Orignally, CoinTerra miner supposed to be 1,600 watts and 2 Th/s. Final product was 2,200+ watts and 1.6 Th/s at best. Not to mention noise are like jet engine as some claimed. One of the owner measured the noise and it was about 78 decibels. That' about the sound of heavy construction equipment or vacuum cleaner.

John, just a heads up, 99.999999% of people who threaten a lawsuit generally just show the company that they are incompetent, because it demonstrates that they have no idea what they are talking about.

I'm not saying you're wrong, far from it. Suing people is EXPENSIVE. Brutally. Suing corporations in other countries? Doubleplus brutal.

In fact, they could owe you significantly more than that and a suit wouldn't be worth it. The point simply is, don't toss around "lawsuit" unless you're going to file one. It just harms your credibility.

Hi,the sad thing is that i am from greece... and i dont know if the news
has reached there... but greece is under a heavy economic crisis, and the
government has raised everything... taxes almost everywhere... even owning
a house you have to pay taxes pes square meter.. and the import fees
scyrocketed to 50% of the price.. so for a machine like terraminer i will
have to pay almost more than 3000$...

I am not willing to pay that fee to the greek government.. so sadly i have
to cancel my order... i will send you the transactions details tomorrow
morning..

40$ for the transaction order of the bank is not a problem.

I have much info and emails to support this...
Personally i ve been waiting for a refund for 50 days...
And they are not even responding...

Forum? Everyone is complaining... No rma no nothing...
Calling them? nah...they are too busy with their 5000 sold units.. and they cannot even reply..

They even offering terraminers to customers for less less money just to avoid refund..

Some of their machines dont even boot.. and of course Rma takes more than a month even if you live next to them..
