Bitcoin traders left out of pocket after Australian-based exchange fails to pay up.

No this is not a Scam at all, we have a huge business launching in which there has been some unforeseen delays. We will definitely be opening in October, we do wish it was in September however we prefer as would our new clients that everything is absolutely perfect.

On the bank issue: this is one of our trade secrets, so I can't discuss the details. But the statement is true. I suppose in the world of banking anything is possible, but it is extremely unlikely that a payment will not get to us or to you do to a frozen account. (...) There has been no expense spared on our exchange, but yet people wish to disprove that IE the hosting which in fact we have our equipment in Australia's top Data Center for security & reliability etc. So, we think that only by proving ourselves is the way in which we can earn trust.

Of course our legal team have covered everything, there is such a thing called customer verification which is required for anything over $500, in which we have rules and policies in place. The Unlimited transfers are for our Bullion business, so there is no money laundering at all possible, we have very strict policies in place and all transfers in and out are facilitated to all legal requirements.

The way to transfer money to Crypto X Change is not via an Australian bank (unless you're in Australia). When you have an account with us, you're matched with a local bank in your country. You can then deposit via internet banking or in-branch cash deposits in your local bank. The $15 fee is the only charge.

That's quite a name you've got there =)  Yes your concerns are understandable. Frankly speaking, Crypto X Change intends to be around for a very long time, and as such we must be very careful to fully comply with Australian AML and "Know Your Customer" (KYC) guidelines. We understand there is a range of opinion within the Bitcoin community on issues of proper security, privacy, and disclosure, and that because of this, some individuals may never wish to trade with us because we comply with AML policies.

If we believe there to be suspicious activity in an account, we reserve the right to freeze it while the course of action is determined. Sometimes this is done in the interest of the account holder (if an account may have been compromised), and other times it is in the interest of the rest of our account holders or ourselves if the account holder is acting illegally. There is no free lunch - an exchange which looks the other way with regards to illegal activities is jeopardizing the accounts of its other customers if it draws suspicion from law enforcement.

Thankfully, Bitcoin itself exists within a free and open marketplace, and users are free to choose with whom they associate and do business. Crypto X Change seeks legal business in full AML compliance over the long term, and thus our Privacy Policy and Terms reflect that (and extra points to you for actually reading a site's policies... more people should do that).

No that would not be considered suspicious. What is an affidavit?

An affidavit is a written form of evidence used in court proceedings. An affidavit sets out the facts as you remember them. In some legal matters, the evidence you want the court to hear about your matter must be in an affidavit (e.g. family law matters).

Does a company owe you money?

The first thing to do is write them a Letter of Demand requesting payment. If your letter is ignored or your demand refuted, you then have the option of taking the party to court. This is done by filing a Summons (or Statement of Claim or Statutory Demand) in the relevant court.

What is a Summons / Statutory Demand?

• Section 9 of the Corporations Law defines a Statutory Demand as:
• A document that is or purports to be a demand served under Section 459E of the  Corporations Law;
• Section 459E provides that a creditor may serve on a company a statutory demand for a single debt that   is due and payable by the company to the creditor or two (2) or more debts due and payable by the company, the total of which must exceed $2,000.

When can I use a Statutory Demand?

• Affter you have obtained default judgment; or,
• Before you commence proceedings by way of Statement of Liquidated Claim.

NB: Only use Statutory Demand to commence proceedings where you are ABSOLUTELY SURE that there is NO possibility of a dispute of whether the debtor owes you the money.

When do you use a statutory demand?
Use it when:

• You are chasing more than $2,000;
• You are absolutely certain that they owe you the money - every penny of it and the debt is crystalised.  That means you do not need to ask a judge to calculate how much money is due to you;
• Your debtor has the money;
• You calculate that your debtor will pay rather than risk your issuing a petition.  This depends of course on his perception of you;
• You are prepared to follow up by issuing a petition.  You hope that might never be necessary.  But, as in any litigation, hesitation comes through in your tactics.  You lose the impact completely if you are seen to be bluffing.

Service of a Statutory Demand

• The Statutory Demand must be served on the registered office of the company (you must do an Australian Securities Commission's Search);
• You cannot serve a Statutory Demand on a foreign company as separate procedures are in place to wind up foreign companies.

Accordingly the delivery to a Debtor Company and non-compliance with the Statutory Demand will provide “proof” which is sufficient for a creditor to apply to the Court for the appointment of a liquidator to the company.
 
Can the Statutory Demand just turn up in the post?

The Statutory Demand may be:

• delivered (or served) by leaving a copy of the document at the registered office of the debtor company; or
• Sent by post to the registered office of the debtor company; or
• delivered personally to the directors who reside in Australia.

So yes, a Statutory Demand could just “turn-up” in the post and still be effective.

What are the new registration requirements?
From 1 November 2011, all providers of remittance services (remitters) must apply to be registered with AUSTRAC, including those that have registered before.

Under the new law, remitters fall into one of three categories: independent remittance dealer, remittance network provider or an affiliate of a remittance network provider.

To apply for registration, all remitters need to:
provide information to AUSTRAC about their remittance business and key personnel
keep certain records about their business
obtain and keep national police certificates for key personnel.

What are the three categories of remitters?

1. Independent remittance dealers are businesses that provide remittance services directly to customers using their own systems and processes. Typically, transfers for customers are conducted through the businesses' bank accounts rather than through a proprietary system provided by another, unrelated legal entity.

2. Remittance network providers are organisations that operate a network of remittance affiliates by providing the systems and services that enable its affiliates to provide remittance services.

3. Affiliate of remittance network provider is a business that provides remittance services to customers as part of a remittance network facilitated by a remittance network provider.

When you initially register with us your account is unverified account and your account has some deposit/withdraw limits applied on your account if it is not verified with us. To enjoy higher deposit and withdraw limits you can verify your account with us as per AML KYC rules.

Consider this a review of two Indian Software Companies who are registered with STPI (Software Technology Parks of India). After I made contact with STPI they didn't even bother to respond.
 
I believe the following are related somehow - writing Software, IT Development and known as RK Futuretech and RLogical.com
 
Don't even bother to search for them to see what they are about because in my opinion they are simply expensive and rubbish developers.
 
Speaking from personal experience you should avoid them like the plaque! They agreed to do a job for me that was supposed to take 30 days (documented in Freelancer) but it was completed privately thus outside of that concern (a lesson to be learned) and was to cost less than a thousand pounds. In reality they were still taking money from me 18 months later, always with a plausible excuse and by now the cost had soared to beyond two thousand pounds and it was far from finished.
 
It didn't work, and would never have worked according to the Company that replaced them!!
 
I dumped RK Futuretech and RLogical.com and am in the process of pursuing them for a refund of my money.
 
Don't get caught out, check the 'POE List' for opinions, good or bad!

Lodge Ophir is opening a specific Charity Account at the Orange Credit Union to launch an urgent appeal to raise money to cover the cost of medication required by Ken Armitt.
 
Ken has been suffering from the rare complaint Idiopathic Intracranial Hypertension for the past three to four years which has now reached a critical stage. His current condition (chronic pain and sensitivity to light) prevents him from working and the extreme pressure on his brain has reached a critical stage. Unless a successful treatment is commenced immediately Ken’s life is threatened.

The medication Octretoide is being used with great success in Europe and America. Ken has a script for the medication but the cost is prohibitive. Unfortunately, octretoide is not available on the PBS and the full cost to cover the critically continuous eight months program must be found by Ken.

Lodge Ophir has received a grant of $5,000 from MasoniCare (United Grand Lodge of NSW & ACT) which is now deposited in the Account. A local Pharmacy is prepared to supply the medication to Ken, directly from the manufacturer at cost. A dinner/auction at the Orange City Bowling Club is being planned for April and Lodge Ophir is running a Masonic Debutant Ball on 3rd June for the appeal.

It is essential to immediately raise more donations to bridge the time before these two events can be organised. The treatment must be continuous once started and needs to start now.

Ken and Roxy have three very young children and if Ken can get started on the medication, from experience, there is a chance he will be well enough to return to work even possibly half way through the treatment.

The Lodge will be appealing for donations from the District Masonic Lodges which are always generous to support needy causes. The appeal needs to be broad ranging within the community.

This is a scam report against CryptoXchange, who has stolen $100,000 USD+ from me and refuses to return it. He told me he had sent the money to me months ago, but that was a lie. To this day I have not received it. Worse yet, he refuses to refund me the BTC I paid to him and refuses to reply on his chats. I am treating this like a legal case and though it is not my responsibility I have taken on the burden of proof in this case against Crypto. I have detailed, highlighted and explained logs ranging from January this year to June of this year in which you will read about how he's scammed and run off with my money. I am asking for a commercial settlement with Crypto, but until then I will continue to make sure everyone knows of the scam he is capable of. His partner in crim currently is Mahin.

You have absolutely no idea what has actually gone on here. As we've stated above were not going to continue replying to this garbage, we are not scammers, please go and find people that are not happy with our exchange!

Whats the average wait time for withdrawal of funds to an Australian bank account from CryptoXChange?
Their helpdesk said it could take upto 10 business days.

I booked a withdrawal order on 6 nov, and still no funds. I have to wait till the 22nd November by my calculations.

I have worked with cryptoxchange before and made deposits/withdrawels fine with massive delay. However at this time i'm attempted to make some withdrawels on my account both on the 6/11/2012 and the 7/11/2012. I'm completly verified, with all my details correctly put into their system for a local bank transfer out.

Now my first issue is that they state that it takes 4-7 days to withdraw the money, it is currently the 15/11/2012 in australia and i have seen nor hide or hair of my money withdrawel. Second it seems they have changed my withdrawel booking dates on both of the withdrawels to the 11/12/2012, now this is commiting fraud.

Steps taken:
Validate bank account - quick support response, all good.
Ordered wire transfer - appears as 'Booked' since 30th of October.
Opened a ticket a few days ago asking about the transfer - no response.

Withdrawal to AUD bank account booked 30th Oct. Haven't received any money whatsoever.

No response to email, PM, helpdesk request so I am opening this topic.

I would say dont send any more money there. The high price of the Orderbook are maybe fake and a honeypot.
