Scam for the project that will not continue and just used those people as free marketing tool to gain exposure for their project. On the other hand, they can't also be forced to pay those hunters because they failed. Most projects that conduct marketing like bounties, doesn't really have a budget for it that's why they will pay you with their tokens if they become successful.

They have allocated budget for some other types of marketing such as in social media's or sponsoring some youtube videos. They will not be advertised if they will not pay upfront. That's the other side of bounties, you won't get paid if the project failed.

You can't really do anything about this, as long as the ICO failed they are not obligated to pay any hunters, and that is why paying bounty with Tokens can be Xtime more money vs paying them with BTC or ETH, you take the risk to not get paid in the case of project fails but in return if the project success your payment will be much more than if you paid with BTC. More risk more reward situation.

If the project just failed to raise money and returned the raised money back to the investor I refuse to call it a scam.

Yeah the rate is alarming, you can’t trust most project these days with a promise of payments in tokens after ICO is successful. You may call it scam, because you didn’t get a payment, but these project team are in loss already and can’t survive to pay bounty hunters.
From this I learnt to do more research into projects am campaigning for just like an investor would do. I think that’s the best practice now.

I think the case here is that, those ICO is closing their projects without even paying for the bounty hunters. In my point of view, a scam means: there is a work or money involved but not compensated properly. That might be the case.

yes you are right, there are some ICO who decide to close the project and return all funds to investors even though they have reached the softcap, so I don't think this is a scam because they still have good intentions to return investor funds, if the bounty hunter doesn't get paid it is a risk and has been valid for a long time
