hmm wow i thought it was in the first place.. so ya good idea then !

It was kept closed source so that the code couldn't be stolen while they were working on features. Apparently the devs have reached a point where they now feel comfortable releasing the code.

Has a third party reviewed the dark send code yet?

Kristov Atlas did the Darksend code review, you can read about it here : http://blog.anonymousbitcoinbook.com/2014/09/darkcoin-code-review-results/
The issues that came out of that review were addressed in a RC5 update (most issues had to do with our two client pairing on Testnet, on Mainnet that changed to
three client-pairing and also other issues were adressed in that update to make a better anonymization possible).
