I have heard of several individuals who have cancelled their preorders already. More delays = more cancellations = less funds for BFL to finish their "product" with.

Where is the evidence that they are spending/have spent pre order money on development?

Why would they need people to pay the entire cost of the products and not simply pay a deposit if their intention wasnt to earn a shitload of interest or use the cash to fund manufacturing ?

How would one come by this evidence? Do you think the company's officers are going to hand over incriminating documents if they exist? People will find out the company is on financial quicksand only if/when it implodes, in which case waiting for evidence would be disastrous. That's what common sense and judgment is for.

This is an interesting thing to consider. If BFL never comes out with a working product eventually they will have burn through their VC or preorder funds and will only be left with a small portion for refunds (that is assuming they don't run with the remaining funds).

This gives people a window of recouping their initial investment.
