That's for sure.  US copyright law states that transfer of copyright ownership is not valid unless explicitly stated in a written and signed contract.  This never took place, and I neither discussed nor had any intentions of handing over copyright ownership.  I sold a license to use a copy of the software, plus the domain and user base that came along with the domain.  Dev still owns the license to use and modify the code, and he is free to use it on another domain.  In fact, I will now give him my permission to sell and distribute the version of code that he has (which is different from what is running on my server since I went through and completely changed the back end).   However, that doesn't mean that I have to give up my right to sell my own copyrighted intellectual property.

The bigger issue, in my opinion, is that he tried to sell a domain that he doesn't own.  He claims he didn't know that it expired, so as far as I'm concerned, this case is closed and I will remove myself from the conversation.

You retroactively converted the sale into a lease, I thought I was dealing in ethical business like a reasonable person, not signing up for a contest in copyright wankery.

A few weeks before the domain expired, I warned dev on two separate occasions that he needed to renew. Once via email and once via PM. I even offered to buy it back from him, but he ignored.

He allowed the domain to expire, and I bought it back.

Also, I think devthdev mentioned somewhere that he did buy the domain+hosting from someone else
Well there you go. Devthedev probably didn't even realize that the domain was (about to) expire.  

This is what happened. I was sold the script/domain last July and recently just didn't have time to continue development, so I listed the script for sale and just realized the domain didn't renew. Looks like unchi, the user who sold it to me snagged the domain as soon as it expired and rehosted the script in an attempt to sell it again. Extremely shady.

The only way this could be shady if somehow unchi abused their position as the original owner... otherwise anybody could have grabbed an expired domain.

Did unchi retain control of domain registration or was it entirely in your control? I'm not sure I understand how you missed the expiration especially since you appeared to be trying to sell it before expiration - coincidence? Did you get e-mails from the registrar? Did you get e-mails from unchi?

On the other hand, I don't get why did unchi even try to warn you if the domain had been sold long ago (not leased etc) and fully in your possession.

Is it really that hard to find the owner? Why all this comedy stalling.... the one who has access to the domain right now is the owner and the "benefit of doubt" for the other comes when he can prove anything...

Why you are doing all this? (not directed at this quote) ... its 2016 and you act like in 1982 with a C64......is it too complicated to check?

The whois record was last updated on Feb 29, 2016, which would point to the domain expiring and then Unchi quickly grabbing it.

someone archiving the site a week before the whois changed (this does not necessarily mean it was renewed -- I think) would be an indication that they were planning on taking the domain after it expired

-the domain expired and Unchi regged it
-devthedev was hacked
-some sort of deal between devthedev and Unchi that went sour
-...

Maybe it's wise to just wait untill both parties had a chance to give an explanation before jumping to conclusions.
- if devthedev sold the domain and script then why he bumped the topic today to sale it
- if domain expired and unchi regged then what about hosting same script
- there is no hack report for his account
- if there was any deal then they must have some proofs of it

Well... I was just trying to give some possible explanations, in order to avoid jumping to conclusions to fast... Some explanations were indeed farfetched, but i think they're all still possible:

- if devthedev sold the domain and script then why he bumped the topic today to sale it => maybe because he didn't realise his domain expired?
- if domain expired and unchi regged then what about hosting same script => because the script is opensource and on github
- there is no hack report for his account => maybe he's AFK for a while, and didn't realise his account being compromised yet... Maybe the hacker didn't even change his PW
- if there was any deal then they must have some proofs of it => offcourse.... That's why i suggested to wait untill both parties had a chance to explain Wink

I know i'm playing the devil's advocate here... I'm not saying devthedev is innocent, i'm just saying that he's a respected member, and he does deserve to give his explanation before he's burned Wink

Might be the explanation, I'm wondering how Unchi would have the script however.
What I think he means is, domain ownership expired and someone else took over. Would that explain the same hosted contents however?

This is very unexpected indeed.

I am curious to hear devthedev's explanation to this situation. There is one explanation that could possibly explain his innocence, although I am not 100% sure if I would believe it or not. I don't want to say what this possible explanation is though in order to prevent him from simply applying my "suggestion"

Its not unexpected, its the flow of whats going on here and that "explanation" you are referring to is "hacked account" ? If so, I also am not even 1% sure if its true. It all looks more like a sinking ship where all rats with some safety jump off board first.

The whole board is rotten and needs some sort of reset... but yes, lets give the benefit of doubt so there is more entertainment for all not involved.

2.5 seems a petty amount for him to scam. At any rate , I've let Blazed know so that he may reconsider removing devthedev from DT until a public explanation from devthedev is posted.
It is possible the amount is higher with different services and deals on forum
