Absolutely correct, it doesn't have to be a replica of the witcher which is copyrighted. But Dice Poker itself isn't copyrighted and can be developed without any worries.

As others mentioned not sure you could use an exact replica due to copyright but could create something very similar.

The layout of the game could be different, but I don't think the rules are covered by any copyright, only the graphic design. It's a very simple game in fact and could be modified a bit as to the number of dice you can reroll and whether you play against another player (simulated by an algorithm) just like in any other card game, or bet on whether you can get a certain "figure" (like in typical dice or roulette).
It would bring some freshness to the game because at the moment most sites offer us the good old PD style dice, which itself is based on satoshidice (correct me if i'm wrong).

It would be a good game but how will the developers make it provably fair?

It's in fact a combination of poker and dice, so if both of these can be made provably fair I see no problem.

If someone tried to implement a casino version of this dice poker from the witcher won't they have a copyright infringement issue with the developer studio?

Oh yes, it would be great, maybe some developers are already on it and we'll get to see this game soon. It's actually very simple and I don't think it would take too much effort in making or getting people to understand how it's played.

I would like to play this game for bitcoin! It would be definitely a breath of fresh air in the stagnant world of dice we know today, where everyone just copy one dice script and people are fine playing it all over again.
Also I want that graphics it is so immersive...

Maybe it would be a good idea to make a bitcoin version of the dice poker. If you ever played The Witcher you'll know what i'm talking about. I've never seen a similar game being played at a casino.
