I'm not from Germany and don't have a clue of the laws but it would sound to me like he's entitled to 5 bitcoins. I'd just keep your mouth shut before you screw yourself over.

The above user is 100% right. 10 Bitcoins are now worth over 22,000 Euros. If you go for a lawsuit, then you may have to give half of that amount to him. If I were in your place, I'd keep my mouth shut.


I'll do the same. Don't ever contact your ex-husband because what he gave you is more than enough to pay your rent and bills. You won't also have to worry if you haven't still find a job until today with that amount.

What he did: stopped paying the rent and the bills and did not let me know, only comunicate dmy lawyers when I had a debt of almost 2.000 euros. He hid his income and give me an assitance of something like 400 euros. What I earn makes 500 euros. He doesnt want to help anymore, I have the rent, all the bills to pay, and I am trying to find a roomate asap.
I am thinking of sueing him, but he says he shouldnt even be helping me in the first place because I have 10 bitcoins that now might count like 10.000 euros and I should just use them.
But I didnt made this investiment for this. I never made a trade (Im a Holder) so I would like to know what to do in this case. Can my bitcoins count against me?

The best is, you need to consult a lawyer who is well versed in the laws of German divorce.
As you are not from Germany basically and it appears you have not yet got citizenship yet, you can contact your country's embassy; they might guide you to proper legal aid.

If he was obliged by law to give you assistance for rent, it might make sense to sue him on that count first. That is far easier than showing that you gave him money with which he bought bitcoins and has absconded with them.

In my own opinion, I think the reason why he avoid the responsibility is because of the fact that he knows the value of the btc you have with you which to me is enough to start a living. I don't know the cost of living in Germany, because over here its enough to start a new life in which I suggest you should got through with and avoid the legal battle so far you have access to cash out those coins then go for it. Maybe part sale because you invest for the future and this is the future in which you investment could bail you out.

besides there is no law regulating cryptocurrency usage in Germany as far as I know

Why not use some of your 10 bitcoins to keep you going until you can find a job and get yourself back on your feet, like you said they are worth in excess of €10k I don't see any reason for you to be struggling when you have access to these funds.

1. Keep your private safe, make sure nobody has access to it (and never had). If it's the case, better move them somewhere safer (new wallet).
2. Get a job and start earning money. You just want to make others' life more miserable for selfish reasons? If he didn't spend your Bitcoin yet, he was not that evil. Get your life on track, think on the future and move on. It'll be best for everybody, really.

I am not so sure of this but if your country is already recognizing Bitcoin as a form of an asset then maybe he can use the Bitcoin. Now, if Bitcoin is not yet that recognized by the government, in my opinion, Bitcoin just means nothing as far as the law is concerned. Please check with people who know more about the divorce law.

What you owned before the marriage is yours only. You sent him money before going to live with him in Germany, so if you can prove it (e.g. have a receipt) the coins belong to you. If you got no proof, he could actually sue you and say those bitcoins are his property, because he paid with his own money.
Whether you can act as a poor person is another matter. If you sue him, he will say that you have enough money to sustain yourself without his help, and he's acting in good faith (sending you €400).
