There is the Law Society in which most of us are subject to through deception but are not bound to it if you can play the game back. How about a Bitcoin Society where we can have our own rules and conduct to abide by. I am no lawyer but I watched a lot of the freeman on the land stuff and did quiet a bit of reading on it. Basically it says that we can form a society with our own rules on uses and conduct with bitcoins separate from other societies law.
I don't think it is necessary for Bitcoin to be trademarked. Just my 2 cents.
Could we please change the thread title to 'Gaven Trademark Bitcoin Now!' instead of 'patent'. There should have been more than enough information provided here in other threads at this point to clear up the patent vs trademark thing.

What does a "patent" actually do? Anything that is created is technically and legally automaticly "undoucmented copyrighted material". Bitcoin is all over the web already, I don't see how they can do this.

Making law enforcement treat users of the client as "pirates", issue takedown notices disrupting major sites etc.
I'm not saying that after all is done Bitcoin would be down for the count, but it would still be somthing i would rather not experience.

Using patent trolling and that DMCA shit would be an easy shortcut to attack Bitcoin...
Attack what part of bitcoin? There is no company running it to sue. It would be like trying to patent bittorrent in an attempt to take down torrent sites. It just wouldn't work. Besides, you have to patent some process or invention that is unique. While the whole bitcoin concept is unique, I don't think it actually has any patentable parts, because it was made from many preexisting technologies.

If somebody try to sue people using bitcoin, there will be a media circus.

There is very little, if anything, to patent. Most of the mechanisms of bitcoin are well known. There is actually very little new about it. That is one of the reasons we can be sure it works.

It would be incapable of patent protection in Europe, I assume other places too, as it has been seen publicly therefore does not satisfy the novelty requirement. It's a strict rule; the windsurf lost patent protection because someone had a photo of some kid that stuck a sail on a surf board before the patent was granted.
Lawyers are expensive. Might not be worth the money.
