So I can say

1)I think kano steals blocks with his pool and it is not legal to do this.

I can't say

2) kano steals blocks with his pool and he is a criminal.

Well if he wants to say I "think" Phil is a liar and uses hacked + modded firmware which I "think" makes Phil a criminal.


Fine with me>.

If he wants to post he thinks:   I am a criminal, but that he has no  actual proof  of me running hacked firmware to mine BTC or any other sha 256 coin.



For the record

I don't think kano steals blocks with his pool.
I don't think kano merge mines on the sly with the pool which would be legal but sleazy.
I don't think kano intentionally acts in a criminal manner.

I do think he is wrong to keep accusing me of running hacked firmware.

Maybe. Depends on the circumstances. If it's a knowingly false allegation, e.g. Alice pays Bob for a widget but Bob says Alice didn't pay and is a scammer/criminal despite blockchain evidence of payment then I think Alice can red trust Bob and even raise a flag. But it's rarely that obvious.

In this case I don't know if kano is making a knowingly false statement of fact or if he thinks that Phil is using infringing software or if he didn't mean to say that Phil is using infringing software, because the sentence could be interpreted as two separate things: 1) Phil and tazers don't care about the license (but are not criminals), and 2) people who use infringing software are criminals. If that was the intent it would be best to reword it to avoid ambiguity.

Well calling someone a criminal without proof shouldn't be allowed imo.
No need for escalation for the moment since you contacted him but members starting to shoot each others with criminal shouldn't be encouraged here.

Question: if someone called another criminal, does this justify negative trust? (not talking about this case).

Also I am not a lawyer but I also think that the activity that is claimed to be criminal is actually civil offense.

Ie you get sued and not jailed.

Which means it is not a crime.

I don’t really care for myself in as much as I am not doing what he claims.

But I think if people are indeed doing what he claims the recourse is in a civil court not a criminal court.

Since I don’t have proper knowledge of each and every country’S rules I would not want to say I am sure about this.

For 🇺🇸 USA I think it is civil offense.

I sell new and used gear and I mine.

I use bitmain and brains 🧠 software on my bitmain gear.

I sell modified bitmain s9 gear ⚙️ with braiins software direct download from braiins website.

or bitmain gear with bitmain firmware.

So whether it is a civil offense or a criminal offense  I simply don’t do it.

I do worry that forum could be harmed  if people that supply the modified firmware sue the forum for allowing a post calling them criminals.

This forum is USA based.  I do not know Law really well but I do feel the post in question has crossed a line.

It is actually directed at a lot of USA based people.

I am not sure it is a properly worded statement.

Well we have been at it for around 2 years.  ever since I told him he was misapplying a formula to state what a pool should have in its reserves.

He decided I was a moron and a stupid idiot.  Which I have decided to completely agree with him on.  I am most Likley the most moronic stupid idiot of all of BitcoinTalk.

I don't mind agreeing to my idiocy and moronism I am cool with it.

But being called a criminal is something I don't take lightly.

So I figured the gambler that I am I would take a shot that kano would accept my request to remove his accusal of me in this case.

I even would agree to being a gambler a moronic stupid idiot which has thinks that I am.

  But not a criminal  I rather he simply take it down and say he was mistaken about me being a criminal . I don't mind if he says he still thinks I am an idiot a moron and a gambler.

But I am not a user of illegal firmware and committing crimes about that. So in the interest of detante I will concede.

1) stupidity
2) moronism ----- I am so stupid I not sure its a word.
3) gambler -------  Heck I will even say I am a compulsive gambler .


but  I would like him to withdraw criminal.

I wrote that document you quoted and the code related to it.

It is up to the driver developer to include ascset commands, since each device driver has it's own unique hardware related to that.

If BM don't include options to change what you want in the API in their driver, that they added to cgminer, then it's not available at the moment.
You'd have to request them, or the only legal firmware release: bOS, to add it to their release.

HiveOS, and every other release for BM hardware in this part of the forum, violates the cgminer license.
That violation includes the firmware released with awesomeminer.
While people like Phil and tazers only care about money and gambling, and don't give a damn about the cgminer license, please avoid joining that crowd of criminals using infringing firmware.

Also note the obvious: the price of BTC changes every day every hour.
You don't know in advance, what price you will get for all the BTC you generated for the days or weeks up to when you sell it.
Pretending that calculations based on the current hourly price and difficulty will directly affect your profit/loss, shows a complete misunderstanding of that.

I use bitmain firmware and braiins firmware.

Both are okay. This is pretty much a direct attack on me for using other firmware which I don't.

I asked for the statement that says

Since I am accused of committing a crime I felt a need to be a bit more formal and make a thread to mention this .

I do not appreciate being called a criminal and frankly would prefer kano to retract the statement with an apology and admitting he was wrong.

Since I know I never used any firmware other then bitmain or braiins on my ant miners. I know he made a false accusation on this forum against me.

kano may believe I use illegal firmware but belief with zero proof is a dangerous road to follow.

Using this forum to state I am engaging in criminal behavior is not acceptable.

especially when I have not stated I do.
I have not sold btc gear with firmware other then bitmain or braiins.

I have not offered to sell firmware for install
No threads about it say I distribute firmware.
