The "may be" in combination with someone selling several phones worries me.

Worried? Hmmm. Would it be practical to lie about the esn being bad so I can get less money? Where do you see several iPhones up for sale?

Bad ESN phones are quite common and most are not stolen.   +1 for being honest and free bump

Thanks man. I buy the phones personally and just sell them. I know the right shit to look for and as long as its mint condition I buy them. Worst case the phone comes up stolen you wouldn't be able to activate in US no matter the case. (ban esn means ban esn)

Only overseas will it operate on another carrier. If your looking for brand new, clean esn just inbox me the specifics.

Ok, this may be a really 'nooby' question but 'Bad ESN' how does that affect usability? What if anything can be done to rectify it so that it can be used? Also: I would be interested in the unlocked one (if by unlocked you mean SIM-card model that can be used with AT&T/Tmobile).
Bad ESN on a 4S means that it cannot be connected to the Sprint or Verizon network in the USA.  It can still be used with wifi (not as a cellular phone) and may be connectable to networks outside of the USA.  Since it is NOT a GSM phone it can not be connected to AT&T/Tmobile. 

Bad ESN is usually for an unpaid bill though it can also be lost/stolen. 

That "may be" is the thing actually worrying me.

Okay, would you prefer that it can not be connectable to networks outside of the USA?
