The hard drives from the Mt. Gox servers that will be delivered to Kraken, as part of this deal, will first be erased/reformatted. That is covered in court papers. I'm curious to know how Kraken plans to apply their expertise without ever being given unfettered access to the original data on those servers.  Are we merely supposed to take on faith that Kobayashi will tell Kraken everything they need to know; that is, should the results of the investigation essentially be a fait accompli--all you have to do is ask this lawyer what happened--then, why even bother having an investigation?
That makes no sense. What is the point of Gox even giving up their servers if they are going to erase everything before they are handed over?
Kraken and JADA have a lot at stake in getting this absolutely right. Ruling Liberal Democratic Party operatives have been promoting the approach being used, and thereby hope to score points with investors. Japan's reputation as an investment destination of choice has been damaged by the Mt. Gox scandal, and they want to do everything possible now to try and guarantee investor's full faith and confidence.  Anything less than a full and honest investigation is more than likely going to backfire on all cooperating entities.

Probably so they can say they gave over the servers, the wiping is for "customer protection" or some crap.  Not like our data hasnt been leaked already.
But that is not really handing over the servers. It is only handing over assets of gox (the physical machines). I am sure that Kraken would have executed a NDA that would prevent them from leaking any customer information

Yeah that is frustrating, nobody but the kraken ceo's brain knows what he is capable of. With random bits of information you can rule out many possibilities.

These questions would not arise if Kraken would get the data and Kobayashi would retain the equipment. The Gox equipment would be better stashed in an evidence room.
Kraken is predestined to analyze the data, not for recycling.

Questions:

- By whom and when the data  got backed up?
- Was there a forensic examination to detect suspicious manipulations?
- An attempt was made to recover suspicious deleted data?

Whatever Kraken will do, the data on the Gox equipment will be destroyed. Then there are only "copies" left. Copies of which no one knows the circumstances under which they were made.
This is exactly how it is meant to be? It is difficult to understand from the outside. What's so special about the Gox devices that they are now necessarily have to be cleaned empty for Kraken? Perhaps these devices are the only existing key to solve the case. The entire project would be doomed from the start.

If they will be registering just to get their money back, chances are they will want to move it out of the exchange ASAP. Volume comes from trading not the payouts.

Most of the problem with growing an exchange if getting people to open accounts and make a trade.  I would be interested in testing out kraken, i hear they are trustworthy/secure.
