How do we know when exchanges actually get hacked or if they simply shut down & run away with our Bitcoins?

I lost a lot of Bitcoins from exchanges closing since 2013, and it is extremely frustrating knowing that most likely they were just stolen and there is no way we will ever get them back. I think exchange owners should be held responsible for all lost and/or stolen Bitcoins regardless of whether they were legitimately hacked or not.

The biggest hack on bitcoin exchanges history - Mt. Gox will be scrutinized in a Tokyo court this week as Mt.Gox’s Mark Karpeles is brought before the law to answer charges of embezzlement and data manipulation.

Let us see if justice will be served for those who has become victim of this hack. But Karpeles lawyer said he will plead not guilty.
If it can get to this point, then I am happy that people are being brought to be responsible for the funds kept on their various exchange site and if anything should happen, they have betrayed the trust of investors in which they should be made to answer to. I hope justice is serve not because he is guilty of the hack or even mismanagement but because I fully believe its his responsibility to keep those funds safe and ensure the hacking didn't happen in the first place.

I'm afraid nobody is going to see any of the coins ever.

No matter how much they pressure him into giving up the private keys, if he keeps up the story that he doesn't have access to them there is nothing they can do.

What is "justice will be served" to you? for me, It's people having their money back and Mark going to jail. I'm however afraid that there is no way they could get the coins back or he admit of what he did, he still might go to jail though.

You are correct mate. That's my definition of "justice' here. I want people get their money back because its so frustrating to see you investment go just like that. But sad, yeah, it you can't get your coins back. This really teach us a lesson not to put a lot of coins in this exchanges for the fear of losing it in an instance. If you can't get your coins back, at least let Mark to go jail so that it will also send a message for those exchanges to fully secure everyone's coin otherwise they will be the one to blame and likely go to jail as well.
