Has anybody been able to trade on MTGOX and transfer usd back to the states lately ? I dont want to sign up and start trading if I will never get my money back

No you will have troubles withdrawing USD to the states from MtGox.

Try to find someone on localbitcoins

If you get your money back it will take weeks or months. I consider having fiat and/or BTC at Gox a liability.

This is the reason why buying at Mt.Gox is a lot more expensive than at other exchanges +5 / +10 %.
I'd buy at bitstamp. Money in, buy, withdraw BTC to paper wallet, done.

I just recently withdrew from bitstamp (SEPA). Took about one or two workdays if I remember correctly.

No. USD withdrawals outside of Japan have very long delays and some are not processed at all.
