Claim only pays out if there is enough funds left to pay out right? So if MtGox is 100% insolvent, and the Bitcoin they have only covers court costs you are screwed correct?

If MtGox has anything left, the lawyers will find a way to drag it out for a long time until they settle with the creditors for the minuscule amount remaining. So yes, this is apparently worth no where near face value. What is the conversion rate to cash out at this supposed "kraken exchange"?

i have received this interesting email yesterday from Kraken :

Hi M.,
We know that some of you have accounts on bitcointalk.org and we wanted to let you know that a phishing attempt was made on bitcointalk email addresses earlier today.
If you received an email with the subject Mtgox.Claim assessment process, delete it and do not click on the link it contains! This email did not come from Kraken, but was spoofed to look as though it came from our support email ([email protected]).

We do not know how the bitcointalk email addresses were obtained, however the bitcointalk database has been compromised in the past. You can be assured that this incident was not the result of any breach in Kraken’s database and your personal information with Kraken is safe.

The exchange rate of the claim doesn't even reflect the real btc/jpy rate, Gox can't just stop to scam us

If a person cant see the the claim they are bidding on anytime soon.

Whats the point of this auction then. I dont think anyones willing to ride out until when these claims actually get resolved..

From what I have read, there are trillions (yes trillions) of dollars worth of claims against the MtGox estate. If you exclude the largest (and likely fraudulent) claim against the MtGox estate then I believe there to be several hundred billion dollars worth of claims, however I also anticipate that many (in terms of volume) to be fraudulent as well.

I understand that roughly 500,000BTC out of roughly 700,000BTC are "missing" from the MtGox estate, and although the amount of missing money is not of the same magnitude, the amount of fiat in the MtGox estate is something less then what their business records show that they should have had. I also believe that the majority of the liabilities that MtGox had was in terms of bitcoin, not fiat. There have also been significant amounts of bankruptcy related costs that will (and/or have) be paid out of the MtGox estate.

I would estimate that the amount of money that claimholders will receive (assuming that only and all legit claimholders are paid) would be somewhere in the range of 14%-28%, at what could potentially be a long time in the future.

I am not sure what a "confirmed claim" is, however I am not sure that the bankruptcy trustee has outright said that any claims are going to be treated as "legit" and/or will not (attempt to) reject any particular claims.
