Not sure where you are from, but if it is anywhere in the USA, it does not seem that they have a leg to stand on and the little bit of a wobbly leg they may have will be kicked out from under them in any court where they pay attention to the facts.
Whoever you are, why are you bumping her threads? Not that I care but it is weird that she is still relevant, even when she's refusing to post.

And @ Mu, I think she wants to sue you because you're not letting her see her daughter. Maybe if you let her just have a small gathering with her, it would work.

you must understand that there are two side to every story and we are only getting 1 side so i can't see many people feeling sorry for you yet, maybe if you could get the other parties to sign up and post then we would understand. But then again this is a bitcoin forum not Jerry Springer or Dr Phil.
....

Okay then. Thank you.

She lives with me now, so.....

Life is too short for all of this drama
Honestly, I don't really see my life as dramatic. I see it as hilarious and knee-slappin' humor! For her to even think her kid will willingly come home when she has no job, no home and no future is super cute. I told my niece to call her mother and just tell her how she feels.

I asked her what her mom said, and she said her mother told her not to tell me anything about the conversation....

It kind of sounds like she has some loyalty to her mom still. Hm. Sad

so much drama... so little time .... you should get yourself on a reality tv show..
If there's going to be a possible lawsuit against me, I really could use the money.

Honestly, I'm not really scared. I laughed the entire time talking with her. It's up to the kid. I know my niece really likes me, and I've spoken to her just now and asked her if she wanted to go home. She told me she'd visit, but she doesn't really want to go home at all. She even said that her mom and dad's place isn't her home and this is her new home now. She's happy here.

I have been extremely lonely the past few months, and having my niece around is a form of human interaction for me before I drive several hours to go to work to just sit behind some computer all day typing up portfolios..

If she ever genuinely wanted to leave me, I don't know what I would do. I've never loved anyone so much and if she was forced away from me, it'd just tear me apart, and it'd end up devastating her in the long run. You can't just take a child out of a home just because it's your child and you feel like it. You have to ask the child if they're happy, and find out whether or not they're going to school and getting check ups. Yes, and yes. This is ridiculous. I don't understand why everyone just has it out for me so much and just wants to see me unhappy.

I don't think you fully understand the law or how court/lawsuits work...

You are going to spend a ton of money taking this to court.  lawyers are not cheap and the process for child custody can be long and arduous, not only on the wallet but on the spirit.

Read up on child custody cases a little more.  They absolutely can and will.  Unless there is documentation (and even then it can still happen for various reasons), there is an extremely good chance the child could be taken.  You should really consult a lawyer about the issue and have someone educated and practiced in the area consult you on your options before you spend a ton of money taking a losing battle to court.
I'm not the one taking it to court. It's her mother.

We had an agreement that their daughter stays with me until the mother finds a stable home and stable source of income, or when the father gets out of jail. That's five long years from now. By then, she won't even remember what her father even looks like. Just because the mother has a new boyfriend does not qualify as either one of the two necessities. I'm the one with a job. It might be a low paying job, but it's hourly, and it's a job. I'm the one with the stable home. And it's a wonderful home. The daughter is happy here. If she was forced out of here just because of legal matters, who is going to suffer here? The child.

The mother is being completely unreasonable.

If you have custody because the parents signed an agreement stating this, that you get their daughter, stick to the agreement. They won't know how to tackle something like their agreement... and their attorney won't show them.

Don't do much of anything else. Simply stick to the agreement thing in court, unless you have somehow broken the terms of the agreement.

Okay, so I just casually went flipping through my mail because I forgot to do so the other day, and I just noticed a really cute letter stating my brother's daughter's mother is taking me to court to fight for the custody of their daughter. I called her right after I read that, and she and I had a really funny conversation about it. Uh, I don't really believe your daughter would want to be around an environment where you do coke all day, and your baby daddy beats you senseless until neighbors step in and call the cops. For her to even think about suing me when I have a stable home and she doesn't is absurd. My niece likes me much more than she ever will like her actual parents, because I take time with her. I treat her well, and I show her what a stable parent is suppose to do. She's seen the difference, and I'm raising her right. I realize we are technically living off of one person's income at my home, whilst my brother's daughter's mother just got a new boyfriend to help with her bills, but that isn't stable at all. I may be alone, but I have the will of many. If she really thinks her daughter will even come back home, that in itself is hilarious enough.

So yeah, I thought you guys would get a chuckle out of that! ^_____^

Oh, and to anybody that wants to pin my sex life or my deliberate nonsensical antics against me, or my past as a homeless girl, well...it seems like you have some questions to ask yourself. I don't behave ridiculous in front of my niece. I don't want her picking up on that at all, and she doesn't. I hate when people say parents are unfit to take care of a child because they like to have fun. You can still have fun. You just hold a restriction of doing it to a minimum amount of time, and you make sure to not do it around the child.
