There is some more low ranked members with avatars on their profile. Sometimes it feels strange when I see Jr. Member or Member with avatar. Some of them even still login in to their accounts, but didn't managed to rank up in these long years, mainly because they were inactive.
It's something unique to have avatar on low ranked account. Same like having animated avatar.

I always thought that they can remove avatar, they just can't add or change it. Well, every day you learn something new

There are a few specifics yes. In the past it was possible to create an avatar even as a newbie.
After the rule change, the existing images remained deposited.
Also animated avatars were possible for a while

This would have been a plausible reason, but when you check on bpip, in both profiles; one has not deleted any post and the other has only 2 posts deleted:

I believe I read somewhere that many years ago, lower ranks could wear an Avatar, and when the rules where changed, those who had it on found keep it, till they changed it, similar to the gif like avatar worn by some users (once changed, they would be unable to wear it).

So, as long as he keeps his profile picture, which he added in 2013 (when it was possible for Newbies, Jr. Members and Members), he's safe to keep it.
