instead of looking for someone advice.Why not just read some thing
about the trademark infringement .. because i dont think there are a lawyer who can give you advice here..

I can read up and will its just im not sure i'd trust my own judgement vs someone whos has been looking into this kinda thing for years.  As far as i can tell so far nobody actually knows the answer.

Wow, I feel sorry for you :S I can't believe that there still isn't a viable alternative to ebay yet with a similarly large userbase.
Hoping Openbazaar gets a huge influx of users once it's released.

Yea, OpenBazaar will solve a lot of these issues, but it would also attract a lot of bad characters. If this happens, a lot of consumers will avoid it, and the concept will fail.

I am not saying you are wrong, or that eBay is correct.... I am saying each case must be taken on merit and carefully considered before action is taken.

There is no simple answer for this... there has to be some kind of consumer protection for sites like this to succeed. The Escrow services is a short term solution to a big problem.

I'm no lawyer, but I'll give you what I know about trademarks. I don't know what the laws are in the EU, but you can't just trademark words (or I could just trademark ASS or what ever I want). It has to be something unique and different. Hakuna Matata is a Swahili phrase according to Wiki

IBM or Microsoft are words that are unique. Hakuna Matata doesn't look unique. They would have a hard time winning in court in my opinion (remember, I'm no lawyer). I don't think they would get much unless they can show you damaged them in some way.

You might want to bring up with them that they can lose their trademark because what they have can't be trademarked and you'll let the trademark office know.

OK thanks very much for that so far im struggling to find much help but that makes sense what you said and gives me extra confidence. 

If you check out their links they provided they are showing they do actually have hakuna matata trademarked?

Yeah thats what i want to do but have no clue how to go about it.  Is there anyone online i could contact?

I posted my current selling situation with ebay up in the legal advice section of reddit, i actually need some legal advice so i'm blatantly asking people here who have reddit accounts to thumbs up my post below #1, hoping someone can help.
