I wonder why our "drill" in cases of plagiarism of design work requires the victim to contact the offender, but in cases of other plagiarism punishment is handed out almost instantly (e.g. post plagiarism). It doesn't make much sense to wait for the offender to respond if they are actually guilty of this, unless the victim wants to 'make some sort of deal' ("settle") with them, no?
If they respond and implicitly or explicitly admit it, they still knowingly did it. If they take steps to 'remedy' the situation, you wouldn't act on it?
I don't think the ICO/company usually makes their own signatures. Chances are, they paid someone to do it, and may not be aware of the plagiarism. I think it's fair to allow them to respond, and possibly come to an agreement with the original designer. In post plagiarism, it's very black and white; either they copied, or didn't. If someone paid someone else to post for them, that's a very rare case that deserves a ban anyway (imo). If they do remedy them, I probably wouldn't act (or leave a neutral) as it doesn't show them intentionally deceiving or doing something untrustworthy.
Not really a "drill" either, I just like to leave reasonable doubt.
