A subpoena is a document (depending on the type) that REQUIRES someone to appear in court or REQUIRES someone to produce evidence in court, if you are served with a subpoena and you don't appear you will usually be arrested and found in "contempt  of court" and usually imprisoned.

If you receive process of service telling you that you are being sued (civil) and you do not show up the plaintiff gets a default judgement.

Subpoenas are usually not used to compel a defendant to appear, they are usually used to compel a witness to appear.

So in the case you sue BFL in a civil matter they will be served at their registered place of business and they should appear, if they don't they lose.

If you bring a criminal action, like fraud, they will still be served and if they were served and don't appear they could be found guilty of that crime.

Its not a subpoena, its receiving process of service.

Which is a notice you are being sued and a notice to appear.

Subpoena requires you to testify.

A process server delivers the notice to appear to the registered address of the corporation and just like on TV they say "You have been served"

And then the process server, if needed will testify that the process was served to the appropriate location and/or the proper person and that is all the court needs. In many cases a certified letter signed for at the registered location of the corporation is also acceptable.

At this late date BFL has not a prayer to get this overturned AS LONG as the Process service was good. If the Process server delivered to the wrong address or something then they could get a hearing. However if BFLs registered address was current at the time and they served there, its open and shut case.

Subpoenas can be delivered in a number of ways; I don't think I ever got around to watching "Pineapple Express" but I'm guessing there was a process server trying to delivery a subpoena in the movie.  Hand delivery is just as valid as the paperwork being sent by registered/certified mail.

When you take money and fail to deliver you would hope that people can recoup their losses. It is clear at this point BFL is clearly to be avoided at all costs and save your self the hassle. There is 0 risk when you don't buy from them and that is the best advice anyone can give members of the community.

In other words, a plaintiff winning a default judgment says very little about another potential plaintiff's chance of winning if defendant shows up in that subsequent plaintiff's case.

YMMV, as always.

It does if they can't get their shit together and figure out which "official" place they are a getting registered mail sent to. It looks clear that BFL seems to be blissfully unaware they were sent anything and this judgement was made. Either that or they lied and basically didn't bother showing up hoping that the case would go away without going to court.

I'm saying that generally speaking, a default judgment, while a victory for the plaintiff in that specific case, isn't precedent for future cases. In other words, if Jim sues Bob for breach of contract, and Bob doesn't show up, Jim will get a default judgment and "win." If Gary then decides to sue Bob for breach of contract and Bob shows up, Gary can't wave around Jim's default judgment and say "Look! He already lost before so he should lose again!"

I'd be more interested to hear your not-an-opinion-or-on the subject that BFL might have a shot at reopening this case.  On one hand, the address on their business license (official mailing address) is where you would think to send registered mail for service.  However, the place does have a website with an address on it.  So there's the common sense thing too...  what do the courts consider reasonable effort to contact in the legal world these days with email, internet, and google?

I don't believe there's conflict in what I said and what my sig says. I apologize if my posts give any other impression.

I am simply explaining that while a default judgment is valid and enforceable (though it may be challenged on specific grounds), it generally does not prevent a defendant from showing up in a subsequent lawsuit brought by a different party and contesting the suit.

In other words, a plaintiff winning a default judgment says very little about another potential plaintiff's chance of winning if defendant shows up in that subsequent plaintiff's case.

After checking into it this, it looks like we've never actually been served directly.  We are investigating the issue further, but it explains why this is the first we've heard of it. We're still trying to figure out who they actually served (if anyone), but it apparently wasn't us.  Unfortunately, the legal system moves a bit slow.

I wonder if this has anything to do with BFL dropping the price on a 50 Gh/s Single to $984 until January 5, or selling a 300 Gh/s Monarch pre-order for $1200 (down from $2800).

It usually does not look good to sell brand new products for more than half off. Seems like a desperate ploy for $$$ to me.

Cash flow problems perhaps?

Likely a 30 day statute of limitations for an appeal.  I'm sure if he's represented by an attorney, that he advised him when to talk about the case...

It's an area we are working on.  I have no direct control over that area, so redirecting any of my energies to that would be fruitless.  Regardless, though, I only post here for entertainment purposes and when I have spare time (like sitting on a plane, holidays, etc...) and it's what I occasionally choose to do with my free time, so again, it would be fruitless, even if I did have direct control over it.
