It is always illegal under federal laws. The rules they follow are rules to avoid admitting the criminal nature of their enterprise in public which is how so many head shops (not just OPD) end up shut down. In this case, the owner has already admitted planning to sell to patients in California and in "legal jurisdictions" which shows we are not talking about tobacco products, has admitted he will check no identification or verify ages, and has admitted planning to import the paraphernalia. This is not an individual who is going to avoid law enforcement.
