eBay is the scam. Just stay off ebay and you will be fine.
Hope you get full refund.

In my case they rejected my claim of refund (small amount, not related to bitcoin) as the fake item was delivered according to tracking.

Refund came today with an apology email were ebay said they were wrong!

Not sure about ebay as to why it took them so long.  I really wish they were faster as to listening to me.  I hope the 2 that won those auctions get refunds.
Ebay is a mystery to me at times with refunds and appeals.

 But I photo I screen shot.

I never say fuck you blow me .  Polite is important.

I was told the content of the small envelopes are mine to keep. Since the seller was banned from ebay.  So   A piece of stone (Jade?) and a Chinese coin . see photo below email

Please let us know when you get your refund.  It seems like ebay is stalling you for your 385 usd refund. They dropped the seller from ebay yet you do not have a refund.

Sad to hear that it was finally a fraud. What a shame, considering the seller has a long selling history (in jewelry, of course).

Fortunately eBay works and protects the buyer, but it is a shame you have wasted your time and expectations in this case  Cry

yeah  I have been with ebay since 2003  over 2000 buys and sells about 600,000 worth of goods.. This will be the third time I file a fraud report.  I wish ebay was faster with this as I am pretty sure 2 other buyers in those auctions will face the same problems I faced.

Yes the second item came to my home on Friday the 24th.  It was a tiny little envelope. (duh like I really thought I would be getting the miner).

I contacted ebay and they are processing my refund.  This will considered a fraud case I will need to sign an email and show photos of the two envelopes.

I was told to open them and look in  first one was a small jade pendant  second one was a Chinese coin.


He was delisted from ebay after my contact with ebay yesterday.  He still managed to sell those two auctions that the thread talks about.

the seller will be long gone and ebay will eat the theft.
That's at least one advantage of going through the system proper - many more avenues for recourse.

Yes the refund case has been escalated. The seller is very clever. He sent a second piece of mail which has not arrived but has shown up in the system of china post.  So ebay has contacted me and told me :
A) they see the first package was a tiny little gift
B) they agree the miner is yet to arrive
C) they have put a 2 week hold on this to allow for item to arrive


The seller is very clever  and realizes that delays favor him.  I will see a refund in two weeks as the item in the mail won't come. the seller will be long gone and ebay will eat the theft.  My cash will be 385 usd tied up from about March 23rd to May 1. Then released.

With low interest 385 would have earned 1 dollar tops so I will end up with that as a loss.  This is the seller

Okay update.  I have not opened the little gift as of today.  I opened a case and I have until May 26th to escalate it.

 I have a new tracking number from him that shows movement of some item and he has promised me he sent a working miner in the package.

His two auctions above did keep on going and he got like 360 and 385 for the two other miners.

So I paid 385 on the 23rd of march with coupons I really paid 335 for it.  Maybe it shows monday the 20th

And when it arrives maybe just maybe it works.

Yes... I hope we can see a happy ending on this. In my case, the gift was an ugly jade pendant of a dragon. And it is greasy, very greasy!!

Philipma, I forgot to mention it. When I had problems with this seller, as he was not answering me I posted on eBay forums to ask their community some recommendations. As in any forum, you will see each one has its opinion of what to do, and people trolling about why I purchased a "miracle machine". But I think it may help you to see your possibilities if things go sour with this guy.

Hi Philipma, do you have news about this? Is he going to send you the miner or did you requested the refund? In case you go ahead and wait hi sends the Avalon, I'm thinking it could be a good idea to open a case on eBay of "item not as described", as if it takes more than 14 days to send you the real miner, you would be unprotected by ebay and Paypal will give him the money.

As I told, in my case I requested him the return, but however yesterday the "gift" arrived. And it is odd, as I live in NYC, you in NJ and you recieved it before (I think all these goods arrive at JFK). OMG, is the ugliest thing I've seen in my life...  Shocked

This is another reason why I dont mess with ebay.

Ebay is great place to snag a deal, but stories like this just makes me really cringe. I rather have a amazon rep helping me out, then some foreign phillpine rep trying to say everythings okay. Nothing against to them, but its how ebay handles their customer support is complete garbage or how they handle it.

I seen far more better results with amazon since most calls are back here in the states, and they actually patch you through the right people way quicker then being on the phone for 5 hrs.

do a immediate chargeback on the credit card, which I`m sure you did already. I checked the link and he seems to have a shitty reputation 97%.

while this is being done, get a hold of a rep and explain what happened. You`ll go through a rough patch of explaining, but you need to save your breath to a upper managment which then transfers the call in the corporate level someone here in the states.

The call then goes through an actual fraud department, and you`ll have to rexplain what happened with the proper item # listed.

its a similar scenario when people list something as x2 units, and when they send you x1 unit with a provided delivery confirmation.



yeah when I purchased he had a decent rep.  He received 7 negatives since I purchased. I file for a refund. I will post back results on this.

Yes, I have the same experience with this guy buying an Avalon 4.1 in the exaclty same listing. First of all, in my case it ended with a refund, so maybe this guy is not a scammer, he is just selling whitout having the units in hand.

3 days after the purchase, he added a tracking number to eBAy. 2 days after we wrote me that for quality check he was going to test the unit for 15 days, and that what he sent me already was a "gift". I answered that as he was a reseller, he hasn't to test anything. Next he wrote that he was imprecise, that it was the manufacturer who was testing. I replied that in that case he was selling something he didn't own in hand, thus he was violating the terms of eBay. Finally he acceded to a full refund.

He has a terrible english and is slow answering, but I hope if you contact him he will accept a refund. Of course, everybody have to be warned with this guy, I don't recommend him.

If you need it to take actions against him on eBay, please PM me, as maybe you can explain them that more people has bad experience with him

EDIT--> Another warn to the people: he is a jewelry seller. In his selling history he has some scrypt miners. However, all that listings were ended by himself in advance, so they are not actual sellings. Everything around him is strange. But as I told, in my case he fully refunded my money. Good luck Philima!!!

He did contact me I can wait a bit  we agreed to see what is up after 3 days. I put in a refund claim so on Weds I will contact ebay if he has not refunded me or shipped the gear.

To anyone looking at the auctions for the avalon 4.1 be very careful.

At Cyrus you could have left it in hardware for a bit longer. Only because no one will see it here and the two auctions are active. I am trying to get them cancelled . If I do I will get back.

He then gave me a second tracking number on the 9th  which is different then the first and he said the real  item was shipped on the 9th of apr express.

Well it is the 12th the second tracking number is "dead"  no record of it at all the correct tracking sites.

He has not answered my ebay messages but he listed 2 more avalon's for auctions.


Since I purchased on the 25th of March  he went from 207 feedbacks 2 bad to current 220 feedbacks 9 bad   that is 7 of the last 13 bad.


please beware of these two auctions.
