Agree ako sa nasa taas ko. Tingin ko masyadong malaking effort if magkakaroon pa ng ganyan na legal way for protection ng digital assets.
If may pagkakatiwalaan man din ako, I will personally just give it to my family members/love one whom I trust enough na hindi nila papakielaman until may mangyari sa akin.

Yan yung opinion ko if iniisip ko yung law towards sa akin. Maybe for others (like millionaires/billionaires), siguro may chance nadin makahelp.

In my own opinion lang ah, tingin ko hindi na kelangan ng law para sa ganyan. Ang naisip ko na pwedeng gawin ay iprint mo lahat ng accounts ng digital assets mo, ilagay mo sa isang sealed na lalagyan at lagyan mo ng notes na if in case merong mangyari sayo na wala ka ng capability na gumalaw or madedz man, pwede nila maaccess ang accounts mo, of course pamilya mo lang ang pagbibilinan mo nun. Kasi kung meron pang ganyan, tingin ko additional na gastos pa din yan eh. Baka mamaya huthutan pa ng pera yung pamilya mo na imbis na may naitulong pa yung digital assets mo, naperwisyo pa sila. Kumbaga tamang preparation lang talaga.

Maraming tao and may mga aktibong online accounts o may digital assets (e.g. widgets, flyer miles, online accounts, bitcoins, Facebook, Twitter, LinkedIn, Snapchat, PayPal, Google Wallet, Amazon, eBay, Robinhood, online bank accounts, YouTube account that generates revenue, Google+, Yahoo, etc.).

Pero anong mangyayari sa digital assets na ito kung ang taong may-ari nito ay namatay o nalumpo?

Kamakailan lamang, ang mga asset na ito ay kadalasan naka-lock at di pwede ma-access. Ang mga pwedeng paraan lamang para kumuha ng access dito ay:

-Sa pamamagitan ng court order. (usually magasto at matagal)
-Sa pamamagitan ng pag-login bilang isang indibidual. (dapat alam mo yung account id at password)
-Sa pamamagitan ng pagiging kasama sa contact list ng pamana sa inactive account. (bihira lang yung may mga taong ganito na successional rights)

Ngunit meron akong nakita na law na ginawa about dito at ito ay galing sa U.S:

"But on September 30, 2016, Governor Cuomo signed into law the Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA). Thanks to RUFADAA, an individual may now authorize their fiduciary (be it an authorized representative, power of attorney, executor, or trustee) certain rights and abilities to access that individual’s “digital asset(s).” (A “digital asset” is an electronic record in which an individual has a right or interest.)

Granting access to one’s representative can be done by either specifying who can have access upon death or incapacity (i) directly on the website (e.g. Google Inactive Manager or Facebook Legacy Account) or (ii) in estate planning documents (Will, Trust, Power of Attorney, Authorization and Consent for Release of Electronically Stored Material).

It is particularly important to have the appropriate language in estate planning documents because many websites or online companies do not have pages, which will allow an individual to insert their succession rights. Indeed, online tools are sparse. If a website or online asset does not have an online tool that allows an individual to set forth the amount of access to authorize a fiduciary, then the clauses in the individual’s estate planning documents will govern.

Most digital custodians only have terms of service agreements. Therefore, appropriate clauses in your estate planning documents to authorize your fiduciary access to your digital assets are both simple to achieve and important to have."

Is it possible kaya through International law, na ma-implement din ito dito sa Pilipinas?
