He’s certainly a bit of a character isn’t he, Zlatan. Fantastic player but he really is a bit of a douche isn’t he.
Take a look at some of his erm, famous quotes -

www.fourfourtwo.com/amp/features/19-best-zlatan-ibrahimovic-quotes-world-according-manchester-uniteds-new-boy

yeah, just like any other narcissistic athlete, nothing new. the company should know about legalities and them using someone's name without asking the guy is unprofessional on their part. the dude may be a douche but he is still on his rights to sue for using his name without asking him.

Now you have to see if there really is an individual contract for the players. With what Ibra says, the problem is that it has not even been AC Milan that gave the rights to EA. In my opinion, Zlatan is not making this up also because there have been similar cases in the past. Hopefully they will solve this problem quickly, because we are the ones who are feeling guilty here.

I don't request loans~
Seems like EA wouldn't have much problems here, it's a problem with FIFPro and the team. Just stupidly odd how they're doing the suing only now, they themselves stated how EA was supposedly "milking" money of off their faces for the past few years. Though if FIFPro did indeed just used the faces of the players without their knowledge, then I guess that's their fault. EA would get damaged by this, but not fully. They only talked negotiations with the responsible authorities, and they got approval, that's it.

After Zlatan Ibramovic, now Gareth Bale is also claiming EA used his name and photo without his permission. EA has been paying players time and again to use their real name and photo and they sometime seem to miss doing that leading to such circumstances. EA would probably pays some good money to both these players and the dispute would settle peacefully.
According to the article, Ibrahimovic is only one, there's already quite a lot of players behind him supporting this move. Now if EA was really an ass, they really need to answer to them properly BUT if EA was only one of the parties that got involved accidentally, then FIFPro would be the one to shoulder everything. And really, even if they pay up money now if EA does admit it's their fault, their reputation would fall a notch imo.

This is interesting.
Probably similar to movie producers  using the "likeness" of real people for the movies. I wonder if that is copyrighted or whether they need permission from their owners to do so. Well, for certain reasons, I don't think I will allow people to do thesame thing with my "likeness" without my permission.
Hopefully, the player is doing that for good/moral reason rather than for money.
What do you mean? Deep fake just like there are some videos of actors who died and they are using their likeness to recreate some scenes from?
I doubt the studio who have done it paid the estate of these actors, living or dead, to use their likeness.
There is some kind of clause in their contracts and they just have their agents take care of the legalities of cases if they arise.

Zlatan Ibrahimovic did not agree to using his likeness in EA Fifa21. As I would of thought every professional player had something in their clause that EA sports was able to use their image and likeness in their video game titles.
Now with the front cover it is obvious they needed to get approval to use them to splash as a promotional model so to sell their games. But this is different.

https://www.dexerto.com/fifa/ea-sports-responds-to-zlatan-ibrahimovics-fifa-21-licensing-threats-1469512/

Also many other players are on Zlatan and his agent's side of this legal case.
https://www.dailymail.co.uk/sport/football/article-8990001/Mino-Raiola-reveals-300-players-ready-join-Zlatan-Ibrahimovic-fight-EA-Sports.html
It is Fair that He ask for permission because EA Fifa  is Making money using their character but nothing even asking to Use them?
That's is showing of know request.
Yeah Celebrities are Public figure and you can just copy their faces any time But if you are going to Make Money and Popularity using them and you did not even say something then thats Foul.

in my opinion he is right even if he is not on the cover of the game his fans maybe they will be tempted to buy the game for the presence of the character, for the presence of the name in the game, is a public figure so if they, producers of the game want to use his name and fame must pay him for the rights

Recently Zlatan Ibramovic questioned the use of his name and face in the FIFA 21 game and he emphatically invited all players to join in refusing to use the name of a football player without their permission. Even though this game has been released for a very long time, even PES has been using the name of a football player for nearly 20 times. On the one hand PES has a contract and cooperation with FIFA which covers all football players but Zlatan's protests also make sense because he uses his name without permission or it could be that Zlatan wants to get a fee for using his name.

Yes every player deserve respect and gaming companies must get permissions as they are the ones ultimately making loads of $$$$

Yes, zlatan ibrahimovic is suing EA for using his image in FIFA 21 it's completely fake ibrahimovic scored the goal by showing the glass art of all the skeptics he has shown that despite his age the debt has not decreased in the least he still has the power to rule the italian league. And he has written his name during a unique record by scoring a goal ibrahimovic is now one among the players to attain in four different decades.

You mean the image is completely fake or the suing?
Just had to search for the news on the suing to understand what you are talking about, or whether the story is true. Few sites seem to report it, like this one: https://www.talkesport.com/news/football-legend-zlatan-ibrahimovic-accuses-ea-sports-fifa-of-fraud/

The story there is quite interesting, esp this part:
Quote
The project has over 400 players on board and aims at suing gaming, betting and data-processing firms for use of their performance data without permission over the last 6 years in a suit that could be worth millions.

In regards to the "use of their performance data" by companies/firms, I think if the data is on Public domain then people should be able to use them for good reasons. It would be wrong if the data is use wrongly or for selfish reasons though.

Zlatan Ibrahimovic did not agree to using his likeness in EA Fifa21.

If I were working at EA, I'd be tempted to say 'fine, we'll remove you from the game'... and then replace him with a fictional tall, skillful Swede, as close to the real thing as I could legally get away with.
Perhaps call him Zlatan It's-not-him-ovic?

I think they could get away with this, but in a perfect/just world they will likely not get away with it, especially if their intentions is to decieve people/customers into thinking the fictional one is Zlatan Ibrahimovic (the real)

He is well known for selling over the world is name so it's kind of normal when your image has been linked even with aromatized water or own a major league football team.
In any case it's correct that he decide to protect his interest and business. Anyone could use for a product and even without consent!
EA sports have used Messi and his image in their games. So what is the issue all the sudden with Zlatan?
Lionel is far more famous than this guy and probably gets paid alot more than him.
This is probably where the lawsuit comes from, hearing how much he makes and so he can only fight EA sports in this manner, with an all the sudden... wait I didn't allow my image to the game. Roll Eyes
I want more money if you are going to continue on with future editions. Wink

This is quite a misunderstanding for sure and using someones image without their approval is not good at all and Zlatan has a a good reason if he  indeed sue EA in using his image without his approval.

I am not so sure if what is the big reason behind this action as it will not be that big for sure if there are no deep reason aside from using the image of Zlatan as right now there are many players who are ready to support Zlatan, this only means that they understand the situation very well in favor of Zlatan.
I don't think this dispute would settle peacefully. I guess it will extend to all the players EA has used their names/photos...without their permissions. The case is so embarassing for EA and will cost it millions of Dollars. However, what about the campagnies who signed the contract with EA ? They ae somehow also responsible .

EA owns nothing at all and needs to pay the copyright.
They need to sign contracts with teams.

What about the agreement between AC Milan and EA? hasn't this company signed a contract with the club? I don't know what the details of the contract are, but what's on my mind, does the contract not include all players that can be used by EA in their game? If the contract deals is including all of AC Milan (stadium, jersey, logo and players etc), I think EA on the right side to use Ibra on their games.  Since the main issue just mentioned about membership of FIFpro, but not mentioned about the clubs deal.
I think EA have contract with AC Milan only not with all player, I know is right what have did by EA but we can't fault for Zlatan to complain with his commercial fee after put his name and his picture on EA game, need solution both them EA game and Zlatan, but I think almost game not have deal with all player to get their name only have contract with FIFpro become player football association and have ask them where is the money fee use from EA working now, the same like what happen with FIFA or UEFA make nation league and complain by Toni Kroos when many player have playing many gamed during FIFA international match and team have loss many player with injury after back from national team.

I find if strange for a multi million dollars company like EA being not careful to digital rights laws.If they truly have not ask him for permission before publishing the game then it is in Zlatan right to sue them.I hope this is sorted out in the best of the ways.

As far as I know, Electronics Arts has a contract with FIFA, which allows them to use in their game real club names, league names, real cups, as well as player names and their images. I have not studied the subtleties on which the lawsuit of Zlatan Ibrahimovic is based. However, I doubt that the lawyers of such a large company would allow the illegal use of someone else's name and image.

Maybe good ideas change Ibrahimovic name with other name but have change to with his image on EA sport, I think Ibra wanna get fee from his name and picture label on EA game and exactly if bring to court this cases will win by Ibrahimovic because every one wanna get the name and picture as label have ask allowed from the owner. But why for this first time Ibra wanna complain where he is last five year or seven years ago why not to try complain why his name on EA game  Grin

I am not sure why EA has used footballers name and lookalike digital models without their permission!! If EA had done that, a footballer like Zlatan Ibrahimovic who earns a whooping salary of 35 million in USD, wouldn't have sued them! However, we love both Zlatan and EA, so I hope some out of court settlement would work out soon!
EA would learn something from this which they would really be aware that there are really players that who doesn't really like for their faces and names to be putted up into something
even if you are a known one or famous.

Its my first time on hearing out this though yet who would be the one will make some contrary on putting up your name or image?
I agree about that he had some character.  Cheesy

It's not something strange and it if the EA game teams/provider notice very well they ought to be aware of this issue before now because for some (300) players to joined Ibrahimovic in the fight against the EA using his image shows that the issue has been talking about among the players that EA scam them off their rights and entitlement.

Yeah I get that much.
But doesn't EA sports owns anything to do with the players in all those leagues. They sponsor each and every game I have watched in the EPL showing their logos on the game clock for gods sake.

So if this legal situation Zlatan has put up has any merit to it, then that means any other athlete from the other sports leagues NFL, NHL, NBA, PGA, NCAA, etc can sue EA for the exact same thing. Embarrassed

EA owns nothing at all and needs to pay the copyright.
They need to sign contracts with teams.

For example in FIFA EA can't use Juventus name, stadium, and suits, they have not paid the copyright, and Juventus sell their stuff exclusively to PES.
(They still can use real names)

Players have the "copyright" on their image and often their contracts have clauses on who can use their name, in this case, pictures.
For companies, the photo of those players is a clickbait to get visibility to the mass.

It's like if you want to sell your lemonade and you put the Coca-Cola logo on the bottle, same thing clickbait and you can't do so.

If he has a contract for his own right I see nothing wrong here.

While using the name and photo of a celebrity to sell a product, they should ask for the permission of those celebrity first. One of the reason why many newer games uses the Name with miss-spelling and a cartoon face is to avoid the royalty. But if EA is using the real name and picture, they should provide a royalty to the players. Considering the practices of EA, they could have made players sign their term without them knowing.
