Even if the company behind this project is based in USA, they can still create a public Initial Coin Offering as long as they will be able to abide by the rules of the country to avoid any legal issues later on.

Nobody is stopping them from having cryptocurrency platform from their country i think the only issues is they are not to make sales there so they might operate but not with the countries investors i think
