Guys, sorry to be a bit of off-topic here, but I am not sure where to ask this...
I am sure everyone here remembers the unfortunate story of BitGrail, so I don't have to remind the details.
I had some funds there, bot BTC and NANO. I, like many here, lost access to those coins, and being frustrated by the situation and by the stupid and irritating actions of the exchange owner, decided to save my nerves, and stop checking the events for some time. I know lawsuit was opened against BitGrail and apparently the users have had some success, but I didn't check further as I am a techie and have very little understanding of formal law-related procedings.
About one week ago I got an email from Bitgrail liquidators, which contained the court decision, and urged me to file a clain as soon as possible, in case I had funds on the exchage. The contents of that mail are generic, and are contained now here:
https://bitgrail.com/procedura-15-eng.html. There is a lot of similar info on
https://bitgrail.com, but being not a lawyer, I have very little clue what to do next.
I sent a mail with few questions to the address provided by liquidators (
[email protected]), but recieved absolutely no reply in two weeks (even after I sent a reminder). Looks like those guys are not checking their email, and are not interested in communication at all.
To make long story short, my main question is:
is there any anybody here who have successfully received back their stolen funds from BitGrail liquidators, and how it was done..?
I would really appreciate any information on this topic. Thanks
Hello,
Since 'the examination of the bankruptcy claim is scheduled for September 24, 2019 at 10:30' (as written in doc your linked) , how could some people have already received their funds back ? I must say i dont get your question. You should fill the form, in the best way you can, and then... wait.
Good luck anyway , i wish you to get your money back, this bitgrail story was a pure shame. Imo that's why Nano is now nearly dead ....
You're probably right
. As I said, I understand very little in judicial proceedings, so pardon my ignorance. I assumed maybe some parts of the funds are already distributed to the ones who submitted their claims after Jan 21 (court decision date), or before that, and so now the remainder is being distributed.
If someone has already filled the claim, I would greatly appreciate if he/she could answer three questions I am puzzled with:
1. How a person could find out what exact amounts he had in BitGrail? The access to the exchange was blocked for a while, so I (in particular) cannot be sure which amounts did I have in BTC and in NANO at the moment of closure (as I had limit trade orders open, and didn't login for a while). Supposedly, the exchange users' database is in the hands of the liquidators now. I assume they should inform me of the exact amounts I am eligible to claim, but I don't see such intention from them.
2. If I understand correctly, they suggest to claim the amounts in EUR. I might be mistaken, but that was my impression, based on the "
The applicable currency is EURO (EUR)." frase. If thats the case, the question is - which exchange rate should be used? The rates on the date of bankruptcy, the date of court decision, and today differ from each other very considerably.
3. They mention "
documents proving the claimed right" several times in the paper. I am not sure which documents do they expect, and aren't those documents in their hands already in the form of the BitGrail users database, with all the coin balances listed there..?
Bottomline... - is there anyone, who could offer their professional service for preparing this doc, or maybe provide me with a sample claim form for a some fee..?
