I guess the only thing you can do is use common sense to try and determine if the topic is actually off-topic or not and has a chance to get moved.

It will most likely not be counted, as it is in the off-topic section at the moment of counting and verifying the posts. And it is also where it sits most of the time.

For me it is also the only reason I sometimes have posts in the off-topic seciton, they got moved.
