Is the Bitcoin Logo patented?

Most certainly not. Patents grant a time-limited monopoly on the use of a novel, publicly dislcosed invention. Even if the concept of using logos for branding was once patentable, it no longer is, due to ample examples of "prior art."

Trademarks on the other hand, grant an indefinite monopoly on the use of distinctive marks. They are designed to reduce confusion in the marketplace, such that you know whom takes responisibility for manufacturing a product.

Copyright may also apply to the logo, but it is my understanding that it is under a relatively liberal public copyright license.

What's also interesting about this is that they are free to use the term 'Bitcoin' directly - they don;t have to invent a fake name, as no one owns the trademark or rights to this. They cannot be sued if they represent Bitcoin in a bad light. They cannot be accused of product placement.
I heard some rumors that Bitcoin is trademarked by mtgox Smiley

If they were dealing with twitter or facebook they would have to create a fake name and hope that the viewer realised who they were satirising, or modify their story and get permission from whichever company owned the name.

It means that in the future any TV show that wants to build a story around money laundering, drugs, free economies, geek culture or whatever can immediately just use the word 'bitcoin'.
Hopefully we'll see more examples of bitcoin popping up as a plot device (even negative uses are fine by me).
I expect to see in used to launder $200million of mob money with the click of a button (despite the impossibility of this) - the Swiss Bank account trope is dead.
