In some states, there is a statute called civil theft that is a derivative of the criminal theft statute. EDIT - I should clarify that theft is actionable even if the stolen property is returned. This is because use of the property can be valuable (so, the temp deprivation can result in damages) and because there's a public policy of deterring theft. In my state, if someone deprives you of property for 1 second, its actionable. Of course, your damages may be nil, in which case you qualify for the statutory minimum which a few hundred bucks.
