I may be wrong to this but I have an idea for that... The bitcointalk exist since 2009 and for what I've known old users are able to use an avatar even if they are a new user and probably the user you've seen created a long time ago and didn't removed his/her avatar since then.
Can you send the profile url of the user you've seen? So we are able to check his/her profile.
Right now you need to be at least Full member in order to wear an avatar.

It is because it was allowed years back but now it is not allowed. Earlier one could set gif avatars too but not now (though there's a feature in beta version !)

as far as I know it is possible that some newbies could wear avatar if they registred before specific date, some long time ago
