If the term is more specifically defined, the smart contract is part of the software that stores the rules for agreeing terms and agreements, automatically checks their fulfillment, and then fulfills the agreed conditions.

That's how these things re supposed to work. Sometimes there are problems though if the terms are not defined as was initially intended. The DAO is a good example for that as a bug in the code could also be considered part of the contract.
