I've sent them a letter before action yesterday as well.

That said - they've got a lot of hashing power and could easily hash themselves out of debt. So I doubt they'll be insolvent, unless to avoid delivering customers products.

Good job bro! I actually posted on reddit the other day with a pretty good return on comments from the other people and it gave me a few second thoughts about pursuing myself. I've the same username on reddit if you would like to read some other people's opinions.? It's good to see a plan in action from someone not willing to take their bullshit.) I personally right now and have weighed mt options and I'm actually content taking the chance that the three singles I receive will make my money back within a month or so. Good luck I hope it works out!! There are just some companies out there that need to be challenged and this is one of they think that they own the world. Smiley

Well I requested my refund last week.  I received notification from Jody at BFL today stating that they will not refund my order in direct contradiction to the FTC 30 Day Policy.  they continue to believe that as long as they are shipping we do not deserve a refund.  So the Warrant of Debt will be filed for $25,000 tomorrow.

Some of the research that my lawyer did shows that the companies legal documentation for their corporation is delinquent.  To him this indicates that the company likely realizes there is a problem and may be preparing for bankruptcy.  Obviously this is speculation, but gives concern that they may feel lawsuits will take longer than they will be in business.

Since I paid in BTC and a bank draft through PayPal I don't have the same protections that credit card would give me.  I"ll post my progress here.  I recommend anyone else being turned down to file a law suite as well.  The Warrant of Debt file in General District court and the processing fees are less than $70.

Since they only have representation in Wyoming, Missouri and New York they will have to spend money running around the country to defend the claims.  If they do not defend them well then they stand to loss the cost of the refund, legal fees and lost revenue for not delivering the miners. 

If you are still waiting, then you must have signed the waiver in April.  Lets say you got the equipment the last day of the waiver ho much BTC did you loose times $130 BTC, it adds up.  General District Court in VA allows up to $25,000 claims.  If they show up and argue the loss revenue they cannot win the refund, it still cost them more in legal fees on my end and their end.  However the case for lost revenue is pretty clear cut, so if they show up great, more money for them to pay. If they don't a default judgement is fine.

Collection will take a little time, but as long as they have assets, they can be confiscated and auctioned by the local Sheriff.  :-)

So we'll see how it goes.  Personally, if I received a refund today I'd be OK with just the $4,048.  Once I file the claim tomorrow it's going to cost them.
