1. Ponzi's aren't scams unless the person who runs it takes the bitcoin for himself

This is not true. If someone makes a promise to someone else that they will give them a certain amount of money and they do not uphold that promise then they are scamming. It does not matter if they took the money themselves or if they gave it to another "lucky" investor who put money into the scam early on 1.
