Just cancel and get a refund, I don't think the legal actions or rights warrant the costs involved.

This is what you can do, by yourself, without an attorney. This is not legal advice.
Preferably done with a Notary serving on the party, for complete proof and evidence.
1.) Write a letter to Josh at Butterfly Labs, claiming certain specifics, like the facts that you ordered, when you ordered, how much you paid and the promises made by Josh, if any. All details as to your transaction possible. Write point for point what occurred, in details.
2.) In your letter, claim that Josh owes you (x) $$ (based on lost profits, all calculated).
3.) Write in your letter, all points and authorities for your claim. Claim in your points and authorities that Josh knew or should have known, that this delay would cost you financially, and that he admits that he owes you these losses. Include the writing that if no rebuttal is provided, that the facts are...that Josh owes you (x) amount.
4.) Give them this notice and call it "Notice of Fault" and give 30 days to respond.
5.) After no response after 30 days, write the same notice to him, instead title "Notice of Default".
6.) After 30 days, give one last notice to correct or forfeit. (If you would like to).
7.) Notice of Lien.
8.) Write a nice letter letting him know all his possessions are up for sale to the highest bidder, place an ad on the forum, naming all his personal possessions and what you would like to sell, and the price. Sell it off to the highest bitcoin bidders, and then give them a bill of sale, and tell them to have the Sheriff collect your due payments  and possessions.

Now everyone can be made "whole" again.
