I offered to Andrew to settle.

For now I believe he is just indebted and ran away from the debts hoping his problems would disappear.

If he replies my e-mail and settles, I will post about it in all the threads related to him, and hope he will settle with other people too Smiley
If he refuses to settle (and not giving a reply until the end of the week I will consider a priori a refusal), then I will also let you know.

But I remember other threads existing I believe. People were quite outraged at his behavior, and in one of the threads bitZino started to be defended as a alternative to bitjack21

I downloaded a cache of his ToS from yandex, cached after this mess with Carlos L. started, and the part about doing whatever he wanted with the bitcoins wasn't there.
I know I sent the cached page to a couple persons, one of them a Moderator(BadBear?) and I think to Carlos L. too(?).

I had business with Andrew, and he was always correct on my dealings with him, hence the reason I tried to distance myself from this, but it's just getting ridiculous now.

But I should have the pages downloaded somewhere in one of the HDD's that roam around my computer. I'll look for them tomorrow, see if I can find them.

So, I know how easily this thread could possibly turn into a conspiracy thread where people accuse the mods/admins of all sorts of BS.  I would like to ask that nobody turn this thread into this.

Essentially, I feel like some mods/admins (in this example, theymos) are being very unfair in scammer tag judgements.
In the Andrew Bitcoiner thread (https://bitcointalksearch.org/topic/--143980), there are many accredited people in the Bitcoin community who have come forward and said that Andrew has scammed them.  Theymos even implicitly agreed that the funds were stolen, yet he claims that since he didn't explicitly say that he couldn't steal out Bitcoins, that he's in the green.

By this logic, I could scam EVERYONE in this forum and not get a scammer tag.  Simply because I didn't say that I couldn't in the contract!

By this logic, every scammer is not actually a scammer.  Pirate is all cool, since he didn't ACTUALLY steal our Bitcoins... We didn't say he couldn't! 

The difficulty with this case, IIRC, is that Andrew Bitcoiner's sites had terms which said that he could do whatever he wanted with deposited bitcoins. I might be willing to give him a scammer tag despite this, but this fact really strengthens his case, especially since not all users are affected.
There has never been a Terms of Service on his website (bitjack21).  I don't understand where he came up with this.  On the rules page, it says that the ToS is located at https://bitjack21.com/tos.php, but it's a 404!

And then, my main point:
Even though he doesn't defend himself, I don't feel like the situation is clear enough for a scammer tag. Mostly because this is an external site with unclear status and agreements. I can't find a provable instance of him actually breaking any agreements.
He's essentially saying here that JUST BECAUSE he didn't agree that he wouldn't steal our BTC, he's allowed to.  One would think this was implied!


I am not asking that theymos be kicked out of the forum or anything (because he owns it, iirc), but I would like to have a civilized (read: NO THROWING AROUND ACCUSATIONS) discussion about how the forum is to hand out scammer tags.

I fully accept that this forum is essentially a monarchy, and therefore theymos's decision is final, but I would think that the forum would want to make more fair judgements than this.

I'm not really sure where you saw that he can do whatever he wants with deposited btc.  Can you point me to where it says that on the site?

Also, think of it like this:  A person sells an iPhone for 20 btc, and the buyer pays him.  However, since the person with the iPhone didn't EXPLICITLY say that he couldn't scam you, he doesn't get a scammer tag.  That's pretty much what you're saying here.

Does this mean that if I run a HYIP, but I don't say that I can't run away with your BTC, that I won't get a scammer tag when I do?  Sound familiar???

It really annoys me how so many people automatically assume corruption when I don't do what you want. I barely even know what Andrew Bitcoiner does/did.

It was incorrect, but all he did was change a topic title. Andrew Bitcoiner could have changed the title back at any time. It's not a big deal.

it's not a big deal when it doesn't effect you directly. i got that.

bet it would be whole different story if false statement was put in topic about you or moonshadow without your ability to fix it and whoever did that and can fix it just ignores you while making runaround jokes about it.

Theymos, there is precisely one person claiming corruption. (thus far).

Personally I would like to distance myself from those allegations as far as possible. I have yet to see one case of cronyism in which you are involved.

If it was anyone else they would of got it months ago.

Same as how you tried to sell all your GBLSE shares 2 days before it all collapsed. If it was anyone else doing that besides you, they would of been a scammer. Its just getting pathetic now. You are not really fooling any one with your favoritism.......
