Well put - it would be worth investigating if cash would speed up the process at eASIC..paying for overtime or something.

You should be on the Board that's a seriously good idea. I'm sure eASIC are working to an agreed deadline, but can that be brought forward if more resources are thrown at the project?

It's actually quite simple. If the company can't make better use of its capital than shareholders, it should go out of business. This isn't a widow / orphan stock, it's a start up tech company where presumably every dollar / coin can be put to use.

Any return of capital, at this point, will be taken as an admission that the company has no confidence in its own ability to deploy capital to increase shareholder wealth.

Getting this NDA is the rearview mirror should definitely be a priority. I'm not sure if it's something money can help, although it's certainly possible.

I'd submit that the NDA is the single biggest source of skepticism surrounding ActM.

And if a super-div payout largely goes back into the stock then speculators could have it all away in a week. Better kept inside the company to do work and we get the eventual profits, not this investment money.

Edit: As to creating a plan for the use of the refund... let's not get bogged down in that. We don't really even have an updated plan as to the main business, so perhaps this is a blessing in disguise. All efforts can be directed toward the eAsic chips, and the infrastructure needed to deploy and sell them.

If we reinvest this refund into the company, I lose the ability to purchase more shares at a lower price thus expanding my ActM ownership which benefits me in the long run.

But the reinvest should - if the business succeeds - make those same shares you hold now worth 10, 15, or 20% more in the future. So for example you could buy 5% more shares with a super-div or hold the same number of shares which will be worth 20% more in value in a few months after a re-invest.

ff makes a really good point - time is crucial and if a reinvest speeds things up we will get mining sooner, at a lower difficulty, and divs will be bigger and come along quicker than with a super-div pay out now.

Also, this idea is naive and uneducated probably, but what about investing money into a Custom chip?

Doesn't sound naive to me. This sure seems an area where ActM is criticized (fairly or otherwise). But I'd be interested in discussing this.

I'm not sure where the website work currently stands, but (as has been noted by Ken/the board) it needs work. In a similar vein, perhaps advertising?  After all, the topic was brought up not long ago that ActM seems to be left out of talk surrounding upcoming 28nm operations in media outlets like Coindesk et al.

Agreed, CoinTerra is successfully spamming r/bitcoin every day. They are getting really high visibility.

I think neilol's point about having a well defined plan for the IRR would be wise. Things have a tendency to just disappear when they aren't allocated to specific needs. The idea of using the money for additional chip/hardware capital seems a decent option.

Clearly if Ken reinvests the money then it's better in the long term as long as all the plans are followed through.

If an investor isn't confident about a total re-invest they wouldn't be happy holding any shares atall surely? I'd just be putting my 'super-div' (TM) into more shares, but if a reinvest makes the shares I hold already worth 10% more in the long run that's a better deal?

A quick comment on this...

Reducing value in the company resulting in an increase in share price is a dangerous situation because it shouldn't, but will, happen. this is why paying out dividends is the wrong thing to do because the "dividends" aren't from profits. They are false.

Why even get measly 800 shares when ACTM is such a shitty Cyrix option? You get only oportunistic cost from doing that. Might as well go with AMD and Intel.

Because there is sufficient irrational exuberance associated with the ACTM security to almost guarantee I'll be able to sell those shares for a good percent more than I paid.

The answer is it depends. Is there a clear plan Ken can articulate for reinvesting the funds at a high IRR (higher than we can achieve on our own) along the lines of the core business of ACTM that fits reasonably within his business plan? If yes then he should re-invest it. If not he should give it back as a dividend.

I expect it'd go back into the revenues needed to get through the various plans, reducing sales requirements accordingly, so potentially speeding things up a little.

Since time is, quite literally, money, I could see its worth.

I would have reinvested my dividends from mining with the Avalon chips, although the share price would have been significantly higher than it is now, due to that success.
