Sonny took care of that, you'd be surprised how "campaign contributions" can help in situations like this  Cheesy
Now wouldn't that be a shocking story. "Butterfly Labs accused of bribing state and federal officials to avoid fraud prosecution"

I mean, it would certainly explain how they've managed to refine their business practices over the last two years, allowing them to stay afloat.

I need to think that such conspiracy theories are just that, however.

Or possibly...

I suppose a legitimately curious question, however, might be "Would Butterfly Labs have been able to survive to present day if it did not have an infusion of preorder funds, maintained by a refusal to issue refunds in a timely manner ?"

BFL staff will be on location at the board manufacturer so we can literally start testing as soon as the first prototype’s last component goes on.

We do have some good engineering news to report this week as well. We can confirm that our most current prototype board version, at 700GH, has continued to perform under rigorous testing. We are due for delivery of production quantities of these boards by the end of this month.

The earlier version boards that perform in the 350-500 GH range are now being produced in quantity. As these boards are assembled they are rigged up in racks and shipped to our cloud mining facility to provide temporary cloud mining to customers in queue priority (we shipped 100 TH of these this week).

We are evaluating our refund policy and will announce details about improvements this coming week, along with new prototype test results as we get them..

Awww, how sweet.   They're evaluating their return policy.  Isn't that like a felon deciding if he wants to murder you or just leave you gagged in the trunk of a car?  Both are illegal, they're trying to see which one works better for them lol.

Where is the state AG?  This is not petty theft, this is multi-million dollar theft!

The funny (or infuriating) thing is, there is a posibility that if you do take up their offer of "cloud mining" your gear might be one of the units providing hashes.

Exactly ponzi ponzi ponzi. Rinse and repeat of the 2012-2013 timeline for the 65nm stuff.

Clueless!
It is pretty amazing how after the first go around and the lateness that people ordered these Monarchs and expected them on time.  I almost feel bad for them because most were probably new customers and did not read up before buying?  I know that 90% of all ASIC sold do not ROI, but these really lost coins.

Good point.  And with each passing day there are another couple hundred new enthusiasts for them prey on.
I would be curious to know how many new orders for the monarch they get a day even now.

on the topic of 'turnover' not the newbie's being sucked into BFL yet as we speak...but is BFL still honoring if you don't get your monarch in 6 months and 1 day
and you get a refund ..or did they 'whip up the scam' GH hosting while you wait..so they can wiggle out of giving you a refund?

my guess is you can't get a refund if BFL is hashing for you at this point (hope I'm wrong for everyones sake)

man I soooo squeaked out that refund due to sonny v's probation hearing the small claims court action

but I bet BFL is not honoring it anymore (I'm guessing here till told otheriwise) due to the fact I've heard of 'very little' pressure on them by the authorities
that are supposed to regulate such things and not a lot from the small claims court stuff

so imho BFL has squirmed away again and plotting new stuff

again hope I'm wrong but my current guess is if they hash for your monarch (even w/o your permission just ask for your address) they will say that their
terms have been fufilled and you are out of luck for the refund when/if they hit that stage of your spot in line

hey "its what BFL does.."Take all my bitcoins" TM

I thought it was common knowledge that luke-jr was being employed by bfl for his involvement?
Point being, the statement from our favorite character is disingenuous at best.

The real question is when did Luke Jr. get something to work on... December 2013 or earlier? That be telling wouldn't it now?

The story has been told already. BFL already admitted to the court they mine with their customers equipment. BCP hid his employment with BFL to shill here. BFL Monarchs won't ship to customers until July 2014 at the earliest (any shenanigans with Luke aside). BFL bought houses and cars for their employees with the pre-order money. Josh likes guys (not that there is anything wrong with that Wink, the Monarch will never generate a positive ROI.

Seriously, what else is there to come out? Time has told, BFL is a train wreck. The court system has started grinding on them.  Wink

It is getting to a point where a monarch (counting elec costs) will NEVER even manage to make 1 BTC at the rate this fiasco is going....

(again so much for usa consumer protection BFL shoulda been shut down a LONG time ago imho)

re-read above still can't believe the only 1 BTC (if you are lucky) a monarch MAY make...but knowing BFL they will even miss that target!

Anyway I was only recently contacted by bfl regarding creating a cgminer driver and only got remote access to a monarch dev board 2 days ago. The one I have access to is only doing 386GH and >8% errors. You can see the cgminer driver I'm developing on my git branch bflsc28.

The PCBs currently in hand (there were several hundred of this revision made) cannot support speeds above ~550GH with "A" chips due to heat constraints
So instead of showing 550GH to their patient customers, it's a better idea to show 350 with a 10% error rate? Right.
I'm calling BS on the 550 number, as there is no reason to publish pictures of a "Monarch hashing!" performing poorly if all it takes is 2 good chips off the shelf to show something approximating advertised performance.

By all means the particular board being shown is a test board that is not going to be sold anyway. Who cares about all the bad boards, it only takes one to demo. Why publish only pics of a bad board if there was at least one board that once did 550? How else would anyone be able to claim they can do 550 if it was never done? More "theoretical performance" ? Bullshit, bullshit and more bullshit.
Quote
Why push the board beyond it's limits just cause the chip can handle it?  The increase in power to run the chips faster causes a greater current draw and therefore a higher W/GH rating.  Why waste the extra electricity for a few extra GH?
The first part is funny, because the picture that was published shows a monarch that is already being run well beyond its limit. 9 percent HW errors + a bunch of rejects is evidence to that. So you were saying?

The second part is erroneous because either way with two of those mythical A chips at least you could SHOW a Monarch working at reasonable speed with reasonable error rates, without pushing the PCB any harder. Better chips run higher clocks with less voltage. Right now BFL has shown nothing but a half broken product, half a year behind schedule. True to historical form I suppose.
Many of the original boards got damaged from heat and are unusable, but I guess that's not a consideration for someone like you. This Rev N board came in today though:
