I have been searching for a reputable betting site and registered about a year ago at Buff.bet in crypto. It is surprising to see such a report of a user being mistreated. I have been having an overall positive experience so far with the site's support and withdrawals paid within a reasonable time frame. I am not familiar with the user's case in detail so cannot take sides in this ongoing discussion. What I mean is that by reading through all this, I have the impression that you seem to make a general assumption out of a single case.

Come on man Buff88, do the only right thing here and give this user GekkeBelg access to his account back and let him withdraw the remaining balance. This is how all bookmakers/casinos do it when they exclude certain countries.

I did some research and your parent compact XB Systems is listed on the Vienna and Munich stock exchanges and planning to join the Nasdaq soon. Do you really want to enter that phase with a scam reputation?

Do the right thing here and the whole outlook will change and all will be back to normal here. Im sure GekkeBelg is even prepared to delete all negative previous posts if you ask him.

Buff, tell us the date since when Germans are no longer allowed to gamble on Buff.bet with crypto

This is not a hard question....just mention the date.

The answer to your question dated back 9 months ago, where our team said that crypto accounts might be registered from Germany, is not actually the case at this moment. We do not accept German players anymore even Crypto.
I will repeat what I said earlier. If that is no longer the case, and you can't have German players on your casino, you can't just apply those rules to a period in time where those regulations weren't yet in place and you were in fact allowed to have players from Germany gambling with crypto. You are doing that currently with this player in question. The appropriate course of action would have been to inform those players who reside in restricted locations and tell them that they are no longer allowed to play on your casino for this and that reason. You didn't do that and went straight to confiscating funds.

Did you understand what LoyceV was trying to tell you? You are heading towards the direction of having Buff.bet being market a scam. Why throw away a decent reputation here for such a foolish act? The ball is in your court, do what you want with it.

Germany will be removed from the registration form for crypto accounts shortly.
Thanks for admitting your website wasn't up to date.

That's all fine, and you can of course change who can or can't play. But you should let them know BEFORE they win on your site. Now you're playing both sides: if someone wins, they can't withdraw, and if someone loses, you take their money too. There's a name for that: scamming.

Quote
All information about the rules applying towards the gambling activity of the German citizens and related restrictions you can find out on the official site of the German authority.
That's also a lousy excuse. You can't expect people to check external sites, if you can't even keep your own site up to date. If German regulators really changed rules for your site, you should have instantly notified the players who confirmed to reside in Germany.

Side note: gambling regulation is meant to protect citizens from scammers, but in reality regulation is often used by shady sites as an excuse to scam players.

@BUFF.bet
I remember that post I made almost a year ago where I asked you why citizens of restricted countries can freely sign up on your casino even if they shouldn't be allowed based on your ToS. You reassured me and the community that players from countries such as Germany aren't allowed to play on Buff.bet with fiat, but they can use crypto and it wouldn't be a problem because such restrictions don't apply when using cryptocurrencies.

What you are doing now is basically the opposite of that. You are preventing a player you know is from a restricted location to continue playing on your platform? You knew he was from Germany and it wasn't a problem for you in the past, but now it's a problem. I wonder if his account would have been closed if he was losing money regularly!?

Based on what I see here, I think that despite the fact that GekkeBelg is from a location whose citizens shouldn't be allowed to gamble on Buff.bet, you told everyone that it was OK as long as they played with crypto. At this point all I can do is advice GekkeBelg to open a scam accusation against you because you confiscated his money. It doesn't matter how much he played, deposited, and won in the past because you didn't have a problem with it in the past.

You said that new regulations don't allow you to have players from Germany on your site. OK, that can be true, I don't know. If it's true, you can't apply rules retroactively and count what the player withdrew from the site in the past when such regulations weren't in place back then. Speaking of new regulations, can you show some proof that your regulator recently requested that you close GekkeBelg's account or the accounts of other German players?

If a scam accusation is opened against your site, you might see your account tagged with negative trust. It's your mistake if you allowed players from restricted jurisdictions to sign up and use your services because you said it was fine to do so. Now you have to do the right thing.

Dear Sir,

The answer to your question dated back 9 months ago, where our team said that crypto accounts might be registered from Germany, is not actually the case at this moment. We do not accept German players anymore even Crypto.

Thank you Loyce. And wow, I didn't even realize I was excluded from his trust ratings. Doesn't look good on Buff88 either.

So Buff88, I'm not a bad person so I want to give you one LAST CHANCE this weekend to come to a solution without me opening a scam accusation topic, contacting your parent company XB Systems (funny enough in Germany) and contacting a lawyer in Curacao (same lawyer who succesfully recovered funds from 1bet victims earlier this year). I know I will get justice in the end, it will just be a tiring long way so I prefer to solve things right here and now.

Facts:
1) in this topic you stated twice that with cryptocurrency users from Germany are accepted. I have screenshots of it in case you decide to delete them.
2) this is also supported by the fact that even today, you can still register as German on your site if you select cryptocurrency instead of fiat. Also have a screenshot of that.
3) I have been gambling for a full year in Buff with Germany as country listed in my profile and did a succesful KYC where your staff clearly saw I was from Germany and all was verified and approved

I don't see all these 3 facts being thrown off the table by any judge.

You've built a reasonably good reputation on here cause I don't see any scam accusations or complaints about you, even though I have seen some in other non-crypto forums. It would be smart to keep it that way and just say sorry we mishandled this situation. Here are your funds back and please withdraw them all cause from now on we won't accept Germans anymore with cryptocurrencies. Then you are following the legal rules and you won't have any dissatisfied customers. Things will get back to normal soon here. We all make mistakes in handling situations, it's how you correct them what makes the real difference. This is still your chance to get out of it without reputation damage.

If by monday morning I still have no solution from you then I will really open the scam accusation topic. People there can see the difference between a frustrated scammer who has no case and just wants to cause damage or between a reasonable person with valid claims who can articulate himself. Therefore many people will give you a bad trust rating and your topic will be marked as a scam topic. I can almost guarantee this will happen. Please think about it and do the right thing before monday morning.

@eGoldgg: you haven't been online in almost 2 years. As the creator of this topic, you may want to respond to GekkeBelg's post.

@Buff88: you're not doing yourself any favours by ignoring GekkeBelg and posting big promotional posts to hide his complaint.
This is what it looks like now: A player won, and you're trying to weasel out instead of paying him.
Let me guess: if a German user lost his funds, you won't return their deposits?

And now, today I requested another withdrawal and suddenly had to do another KYC. And this time after sending them all the documents, my account got closed and all funds confiscated (399mbtc). Stating this as reason:
Quote
~ as a German resident, you are in breach of our T&C’s. Your account will be permanently closed
~
all bets placed are in breach of the applicable law will be deemed void, and any deposits made to be refunded.

Allow me to quote this by myself:
We do not accept customers from Germany with Fiat currencies, with crypto (we accept BTC,ETH,LTC) you can actually make an account Smiley

I'm curious: what's the relation between user eGoldgg, user Buff88 and website BUFF.bet? Is there any post or link to confirm they're officially affiliated? That's kinda important for Flag Support.

@GekkeBelg: you should create a proper Scam Accusation. I can't independently verify all your evidence, but I've seen no reason to doubt anything you've posted.
@Buff88: think very hard if scamming 399 mBTC is worth having this warning above every page of this topic:

If it isn't solved today I will file complaints at several websites including a scam accusation on this forum and a complaint at the Curacao Gaming Authority (not the normal way because I know they don't give a fuck about normal clients, but via a lawyer). i am even prepared to go to court over this.

It been 2 days after your last warning to buff.bet but I do not see you created a scam accusation thread against them. Is it resolved already and you get your balance back? Kindly give an update about your case as buff.bet seems to ignore your last warning with no more posts related to your case. If it is yet to resolve, scam accusation thread is the one you should do to warn other people so others wont experience similar issue.

It's not resvolved. I will open the scam accusation topic very soon.

If Buff.bet does not honor the remaing balance of customers they ban due to new national regulation, but instead confiscate the winnings without prior notice, this site is a scam. There can't be two opinions about that.

I agree with all of the above. And I can also add: even today Germany is still in the country list when you try to sign up with crypto, and German IP-addresses are not banned.
And if it's true that the situation in regards to laws recently changed, they should have informed me and all other German users that this was going to take place. And ofcourse, change their signup page and remove Germany from the list. All of this was not done and I also get the impression that they looked for an easy way out of not having to pay me now that my account is in profit.
Buff, I am giving you today until midnight to solve this in a good manner. Either Re-open my account and let me gamble again, or keep the account closed but ask me to provide a withdrawal address where my remaining balance of 399mbtc will be sent to. If one of the two options does not happen, I will open the scam accusation thread on here and also submit complaints at Askgamblers and the Curacao Gaming authority. They will then also find out that you are at the moment accepting players from Spain and Netherlands, which is in fact forbidden according to the terms of your license. I can't imagine they will be happy to find out that you were in breach of their terms all this time.

Buffbet, why dont you accept customers from Germany actually? All other crypto books do.

Hello GekkeBelg,

We do not accept customers from Germany with Fiat currencies, with crypto (we accept BTC,ETH,LTC) you can actually make an account Smiley

Hello, I am really really mad.

As you can see above, I clearly asked you if German customers are allowed to sign up and you said not with fiat but with crypto it is okay.

A bit later you even confirmed this to another user, see here:
@BUFF.bet

I often check casinos and whether or not they allow players from restricted jurisdictions to access and open accounts at their sites.
You can read more about that here if you want > https://bitcointalksearch.org/topic/--5278411.
The post where I tested Buff.bet as well is here > https://bitcointalksearch.org/topic/--5278411.

Germany, USA and UK are some of the countries that are restricted based on the info available in your TOS. I tried to access your site with VPNs from all 3 countries and I was successful in registering new accounts each time.

Some casinos have IP blocks that detect and restrict or provide a notification when someone is trying to enter the casino from a restricted location. Is that something that can be implemented at BUFF.bet as well?

Hello, Pmalek.
The mentioned countries are restricted when registering with FIAT currencies, that does not apply to crypto betting as such accounts are anonymous and can play from anywhere due to the way crypto is structured.

This is also proven by the fact that when you try to sign up and select Euro, Germany is not on the country list, as you can see here:
https://imgur.com/mIOyEFM
But when you select Bitcoin, Germany does appear on the country list:
https://imgur.com/Zm36Lor
So after explicitly asking, I opened an account All was fine, I placed bets for several months and did several deposits and withdrawals. I even had to undertake an extensive KYC in February which I passed. So your staff clearly saw here also that I was from Germany and all this time it was fine.

And now, today I requested another withdrawal and suddenly had to do another KYC. And this time after sending them all the documents, my account got closed and all funds confiscated (399mbtc). Stating this as reason:

Thank you for the provided photos.

After thoroughly reviewing the provided files with our compliance and legal team it was deemed that, as a German resident, you are in breach of our T&C’s. Your account will be permanently closed in accordance with the released note by the German government body, not allowing us to accept bets and transactions, regardless the type of currency, from users residing in Germany.

Following from this, and being bound by the legal note of the relevant authority, all bets placed are in breach of the applicable law will be deemed void, and any deposits made to be refunded.

After carefully checking the transaction history of all incoming and outgoing transfers since initial account registration, the total amount of your deposits equals to 430 mBTC, while the total withdrawn amount up until now is 500 mBTC. With that being said, we consider that all deposits made so far have been reimbursed and there are no deposits left to be refunded.

Taking the above points into consideration the following terms and conditions have been breached:
3.5 We do not intend for anyone to use the Online Casino/Sportsbook and/or the Website where such use is illegal. The availability of the Online Casino/Sportsbook and/or the Website does not constitute an offer or invitation by us to use the Online Casino/Sportsbook in any place in which such use is illegal. We don’t offer our services to residents from following country or territory: Australia, Austria, Belarus, Belgium, Germany, France, Kazakhstan, Poland, Russia, Slovakia (Slovak Republic), Ukraine, United Kingdom, United States of America, S.A.R. and Bulgaria.

We would like to advise you to refrain from registering another account with us as it will be permanently closed and balance voided.

Best regards,
Buff.bet Customer Support team

I am giving you one last chance to set this right and prove this all was a mistake of your department which closed my account. You cannot say stuff here and act otherwise afterwards. This would be completely unfair and make your company untrustworthy. Also you cannot let a person bet for a year and approve their KYC and then half a year later reject the same KYC with the same documents and confiscate an entire balance.
Please investigate this issue and correct the situation by reinstating my account. In that case my complaint will stop right here and we will just consider it a miscommunication between departments in your company. But if not, then I see no other option than to submit complaints at several different places because if this is truly intentional then wow this is filthy behaviour. And in case you will try to delete postings on here that accounts in crypto are allowed from Germany, I already made screenshots of it so don't bother.

For now, I will just believe this is a huge miscommunication between intern departments at Buff88, and that things will be fine. Cause I cannot believe that such a respectable company would really do this. Maybe the department which closed my account did not realize the rules were different for crypto accounts than for fiat accounts. It's a logical explanation and in that case it was only a human error and at least no bad intentions. In that case I can let it go after your solve things. Let's see.

Dear user,

As you are probably aware, online gambling regulation and legislation is constantly evolving and operators must comply with the latest regulations of the jurisdiction.

Given the recent regulatory changes made in Germany we were forced to close all registered accounts from that jurisdiction which includes both fiat and crypto currency accounts. In order to confirm your current address and citizenship, you were asked to provide us with an up-to-date set of KYC documents. After checking and confirming the actual address of your residence, we closed your account as we were required to do so by law.

You are missing my point. You clearly said that crypto accounts are allowed from Germany (and other countries such as USA etc). I have a crypto only account.

Buffbet, why dont you accept customers from Germany actually? All other crypto books do.

Hello GekkeBelg,

We do not accept customers from Germany with Fiat currencies, with crypto (we accept BTC,ETH,LTC) you can actually make an account Smiley

When you go to your signup page you also see that Germany is not on the list of countries when signing up with Fiat currency, but they are on the list when you select Bitcoin.
You are allowing clients from Germany to register with crypto.
And next to this, you had me as a customer for 1 year and all this time you knew I was from Germany. I have done a succesful KYC before and all was fine. And now when I made some winnings you are suddenly throwing me out. This is completely unfair and I am giving you today as the last day you can solve this in a fair way by either re-opening my account or alternatively sending me the 399mbtc I had on my account.
And by the way, according to your licensor Germany is not a forbidden country as you can see:
Quote
Under this license, apart from its own diligence and legalities, the license holder is not authorized to offer its services in the territories of Aruba, Bonaire, Curaçao, France, Netherlands, Australia, UK, Spain, Saba, Statia, St Martin, USA, or any other jurisdiction that the Central Government of Curaçao (formerly the Netherlands Antilles) deems online gambling illegal or are blacklisted.
If it isn't solved today I will file complaints at several websites including a scam accusation on this forum and a complaint at the Curacao Gaming Authority (not the normal way because I know they don't give a fuck about normal clients, but via a lawyer). i am even prepared to go to court over this.
