I really don't think it is. Granted IANAL, but the precedent in most industries is that if the unit is priced at USD$XX.XX and you pay BTC/EUR/CDN$YY.YY, when you get a refund a month later you will get back BTC/EUR/CDN$ZZ.ZZ, worth USD$XX.XX.
If you go before the arbiter and that quote is the only evidence you have that HashFast promised to pay back the same amount of BTC, I would be surprised if the judgement went your way.

That quote I do remember. They were asked if they would be given the same amount of BTC, but the answer does not say that. It only says that orders were taken in BTC and refunds would be given in BTC. He didn't say the quantity would be the same. As far as I know, the only statement saying the that the quantity would be the same was ninjarobot's hearsay account from his visit to the office.

Is there a post from a HashFast representative saying that the refund will be in the amount and type of currency paid in, or just in the type of currency paid in?

I'd actually prefer they came out and say that the refund will be in the type of payment but valued by the current exchange rate rather then them promising to return the same amount of BTC that was paid. Unless they can show that they never actually exchanged the BTC to USD to begin with, even if the price of BTC stays at the current $600 level ever single Batch 1 customer who owns a calculator will be demanding a refund on January first should HashFast slip.

HF claiming that they might refund me $30k+ worth of BTC on January 1 for my $5,600 purchase smacks of someone saying whatever placates the crowd the most knowing that they will never carry through on it.

I found it hard to believe and assumed initially that "refund in BTC" means USD amount converted to current exchange rate" but in thread I was corrected with multiple quotes from HF indicated refunds will be the EXACT currency and amount paid (i.e. if you paid 60 BTC the refund owed would be 60 BTC).  It is possible they didn't convert BTC to USD or at least not all of it. HashFast indicated they had venture funding and bitpay does offer the ability to accept BTC payments and keep some or all of it in BTC.

I would have to agree. People suddenly want refunds in BTC as an investment they never made. If you invested in BTC, then that's that. If you paid for something in BTC, then BTC rises, you can't demand a refund for an easy second route. A couple of weeks ago, cedivad let me borrow ~.03 btc when they were at around 100 something dollars. I just needed to get some btc out of my Bitpay. I told him I would pay it back, he said I could keep it. I said okay and thanks. Suddenly when BTC started rising, he told me to pay him back or he was going to make a claim against me here on BTC talk. I didn't have the coins anymore because I used them, because he let me have them.

I think we should all stop focusing on getting refunded in BTC and suddenly being rich over an in direct investment. We all purchased Baby jets. And we need to focus on getting those. If you want a refund, have some morals and be honest.

Let's try to get what we paid for.
