I just cant believe that after a year, your girlfriend still so questions you !!! I mean if she doesn't remember anything all she has to do is just ask you. And the way you told about it, there's nothing wrong about it at all. I have been through much worse.

I'm in the U.S. luckily. I ask this cause shit has gotten serious between me and my ex and its become REAL bad as in police involvement over our arguing for our shit and such. Essentially now if either of us talk to the other its harrassment. Shes been selling her adderall and she had her new boy come and be a tough guy and try telling me shit...like fuk no sir. I ain't about to lose my job and get arrested by throwing the first punch but I wanted to. Anyways I reported her to police and her doctors for selling addy along with her stealing my shit (which I eventually got back with police involvement), I just want to make sure she can't cry rape and try revenge against me now.

Seriously, if what you say is true, I doubt the police would take any accusation of rape seriously.

As individuals, the police are idiot bullies.  Their prosecutors, however, are not.

They would simply ask your ex why she did not inform them of the rape when everything got REAL bad.  They will ask why she was protecting you.  She won't have any answer.  The case will be closed.

Again, I'm not a lawyer - I just think that is common sense.  Just don't be stupid and send her a text along the lines of "at least I got to do you one last time without you knowing!" Smiley

In some jurisdictions rape = any situation that the woman said was rape, no matter if there is no evidence or the fact that it happened years ago.

Next time if she doesn't remember you probably won't make her remember to avoid such problems

You can't be sure - so don't take legal advice from a bitcoin forum.  IMO the longer a person waits, the less credible their story becomes.  If it was me that was raped, I'd be running out the door still naked, pounding on my neighbor's house screaming for the police....

My ex brought up something that realllyy hit me hard and angered me. She said I "technically raped her" but she wasn't going to report it. Um okay...

Heres the story and I want to know if you agree she was raped or not:

One night after 3 hours of studying it was 3am and we were still on Adderall (meaning almost impossible to fall asleep) so I gave me and her a sleeping pill after she asked for one. The sleeping pill I'm prescribed is ambien. Anyways, we get in bed and we both start feeling for lack of a better word, LOOPY. Like seeing stuff, feeling weird and feeling light, was just interesting. Next thing I know she starts touching me all over and then starts kissing me. At this time we've been dating for over a year so we've had sex many times. So I took it as oh sweet my girlfriend coming on to me, gonna have before-sleep sex which is always nice...anyways who is sexually active and good at sex themselves know that if done right both people can pass the fuck out after a good round of sleep and not wake up til next morning.

So she continues to feel me up and all, we start undressing, go thru foreplay, blah blah blah, have sex for 30 minutes and then pass out.
The next morning she tells me she doesn't remember a thing. I clearly do myself and I asked her if she remembers that we had sex. She doesn't. She then says woah thats rape but obviously in a relationship this didn't mean anything but it still made us both feel weird at such a suggestion of that being that.

What do you guys think? I have no knowledge that ambien makes you have memory loss, all I knew was that it makes you loopy and see things sometimes. She also came onto me and was first to make the first actual "sexual advancement" towards me (if you understand what I mean). I don't believe I raped her at all but I am curious to hear what people think on this story.

That's not rape at all what the op described, but that shows how screwed the mindset of a lot of people is these days to automatically cry "rape" on someone they've been in a relationship with for some time and the sex was clearly consensual.

You can always consider a hidden camera in your bedroom for times like this.  Now both parties have a reasonable expectation of privacy in a bedroom, so you could get in a lot of trouble if you were to make those videos available to anyone, except in defense.

But as a incontestable legal defense, a camera is becoming more socially acceptable to prevent against vindictive charges of rape.

As said in the UK it would be rape many many people have been convicted over this sort of stuff in the UK. the judge and jury will see it as you giving her drugs. so shes no longer i a position of "sound mind" so shes then incapable of consenting to anything.

P.S im from the UK and the law is so fucked up and the courts are still in the 1800's its stupid

You should probably check on the definition of rape because just because someone is your girlfriend does not mean they are yours for you to have sex with whenever you want or against their will. You still need consent. I don't believe this scenario to be a case of rape but people have been charged for drunken sex even though it was almost certainly consensual at the time (but there are also cases where someone is too drunk to properly consent so it can often be a tricky area legally).

Seriously, I think she needs a doctor. Some drugs able to amplify existent health issues. Somnambulism may cause such weird situations and it's very dangerous because such people are literally walking and even talking asleep. She can trigger the gas explosion, car accident or something worse and then won't remember anything.

No it's not rape and it sounds like it was entirely consensual at the time. Both of you were on drugs so it's not like you purposely drugged her with a daterape drug but obviously there might be a legal grey area since she can't recall consenting so you could get into trouble possibly, but from the sounds of it I don't think she'd press charges but maybe she could if she wanted to.
