Cost is why I suggest filing with the FTC. IF the gov thinks there is is a valid case they bear the burden of pursing it. If the infringement is as cut and dry as Kano et al say, then given the size of Bitmain's market I'd think the FTC and their counterparts in other countries would be very interested. Does the FTC ever enforce copyright law? I thought it's up to individual copyright holders to enforce their rights.

Yes, they do and generally like to publicize it if they can get Media attention. It is up to the copyright holders to file the complaint though and give reasonable proof of Harm.

Prime things in the past has usually been knock-offs of Designer items: clothes, accessories, watches, eyeglass frames, etc. or large Publishing Houses trying to stop un-contracted resale of books. Ya can see why the Media normally just yawns. Now something dealing with Bitcoin... Bingo!

We could be forced to try, if KANO and -CK decides to work against the community and I really would not like that outcome at all. I know jack if this is even possible, but I know that FUBLY is the guy who could and can rewrite the BMMiner and get us all the CGminer 4.9.2 for the S9.

I would rather have the CGminer 4.9.2 on the S9 instead of BFGminer...........but hey, anything is better than the BMMiner.
I too would rather have the sw be based on CGminer. Mainly because that is what the miners already use which I'd think eliminates a ton of re-coding and the inevitable bugs that can pop up in doing it.

Just tossing out possible options for consideration if folks can't get together.

I said they do eventually comply with it so there's no case to bring up against them. I doubt suing fubly would serve much purpose...

Well it's broken in that it's in violation of gpl. And since Kano ck are so bent out of shape about it I can't understand why they don't do something about it.  Put their money where their mouth is and force bitmain to open source the code or face a hefty fine.  Or is it that the gpl is a joke and no one actually ever does that?
Bitmain skirt around the edges of legality with the GPL. You are obliged to provide code to any binaries you distribute within 30 days of being asked if someone has received those binaries and requested the source to them. Bitmain has always ended up releasing source code though it often takes longer than 30 days which is usually when Kano starts getting loud about them breaking the GPL - however if no one asks for the source code, and only those in possession of the binaries have that right, then they're not obliged to do anything. This is totally different to the fubly+cgminer+cryptoglance story which is the main complaint on this thread.

As for pursuing companies breaking the GPL through law, that takes money and internationally is close to futile when it comes to China. We're not big companies with big budgets to burn on lawsuits with only a borderline chance of success, and I doubt it will lead to any great recompense on our part should we win. But as I said, Bitmain eventually have complied.

High CPU usage?! This looks normal atm.
S9 uses a more powerful controller than the old hardware if I'm not mistaken.
S9 appears to use hardware/FPGA work generation unlike the previous bitmain miners which do it in software so low CPU usage is expected even on bitmain stock firmware.
Tupsu, my friend. I got 2 dead controller boards (Changed by Bitmain) 2 dead IO boards (Changed by Bitmain) and 3 dead hash boards currently at repair at Bitmain. I have 20 S9`s and 100+ S7 and the S7 runs without hick-ups. The S9`s by the way is a costant monitorring hell. Needs power cycle, Needs restart, Change of data center fuses, constant blowout. Somehow only 1 S9 pr. 2880W server PSU seems to run. When connecting 2, the fuses blow ??
So for me it would be a relief to get Fubly to make the firmware for the S9`s

I say YES, damn YES!

Don't expect these issues to be fixed by replacing bmminer with cgminer, these issues are likely much lower level.

My point also Citronic. We need a comment from KANO here.
I want this damn BMminer to dissapear with all its fault as stated by -CK. It is only in all interest to get these damn S9`s working with Cgminer 4.9.2 so we get in control again.
In my point of view, Fubly is the guy who can make this happen with some guidense from Kano and -CK. The issue with bitmain's fork is both the core cgminer code and their driver. High CPU usage, throwing away shares, getting best share wrong, massive wasteful work queues that add to latencies are the things I recall off the top of my head

Could you do the consensus ? Im pretty sure most S9 owners would prefer to get the CGmiiner on their iron.

Put all the personal issues aside - and let's get a good win-win outcome.

Also, we need kano's feedback - I have not his latest post - I hope his feedback will be favourable.

If we cannot get our act together - it will only benefit Bitmain and the other pools.

We need to decide - YES or NO to the fork, and get back to business.

If anything, file a complaint against Bitmain with the Federal Trade Commission (in the USA) or their equivalent in other countries. They can and very often will impose an import ban on anything that can be proven to violate Copyright. That will certainly get Bitmain's attention...

This is not some new news, that i have 7 failed hashboards from S9 + one with only one X
+ one board with one X heal itself.

But I do not have any broken or "bricked"  S9 controllers.

I had some from S7, I bought a broken and sold seller a working controller against him broken one.
It was always a not working B.B.B.

Recently I needed a reset button several years ago for KNC Jupiters.
There has never been a need to press the reset button from any Antminer .

Some users need reset button  as soon as possible. Perhaps here lies the secret?

Your mining farm  may  be higher,  but a friend of mine has been mined more than 800 BTC  Grin

Everything in BTC depends on the right timing, not  FARM  size.

Dear Community,

I deleted now all the code from github. I want to start from scratch.

The first thing I had to do is make a fork and then publishing there my code.

It is absolut clear and readable from everyone.


Let me go back to this point:

I have been watching this thread with high hopes that a working updated firmware with version 4.9.2 of cgminer will surface.

Still committed to sending BTC for the reward in the amount I promised once a working version is available and tested on an S9.

Thanks so much guys.  To hell with bitmain for not releasing this.  Karma is a mysterious beast.  Looking forward to avalon miners to come soon:).  And since bitmain clearly marketed these r4 for home miners then what did i buy when i bought the s9.. And if its datacenter only will they be honoring a trade in.. Ill happily trade three r4 that dont sound like a fighter jet for my 2 s9.  Ive never seen a company bite its own foot so many times within such a short period of time.  uffff

Make sure whoever releases one, releases the full source code, otherwise you are in no better situation.
Fubly still hasn't released the full cgminer code for his hacks, he's hiding code and thus breaking the license.

And now someone of this thread- and bounty-community tells me this!

Great idea, but stop working, it could be that you where working for nothing.
We ask the Developer Team Kano and -ck what you have to do, for not violating and GPL rules.


for example:
Dev-Team:

  • We accept only this way
  • you have to do this
  • do not this
  • and this and this and this
  • push that
  • fork this
  • rebase this
  • and so on
  • BREAK

Bounty-Donators:
  • Talk with the dev team and find the breakpoints
  • Also we need this
  • and that
  • and this function
  • and this option
  • and this service
  • and and and
  • BREAK

And every Function, Service, Button and so on, which follows after this BREAK is not acceptable to implement it also for free only to get the bounty.


Escrom-Team-Menber: (has absolute nothing todo with you phil)

  • start opening escrow address
  • collect the money
  • do not refund the collected money, until the dev team gives a 3 chances to fix a violation or what else
  • Red Light from the dev team, give the coder a chance to do fix it
  • for this the dev team has to tell what is wrong
  • Green light from the dev team - send the btc to the coder

Who makes the decision, I think only the dev team has the decision. And none else. Because for what stand the escrow.
For security that every party will get what they want.


Coder:
  • do all what the dev team want- to the point where is the BREAK
  • do all what the donators want - to the point where is the BREAK
  • and you will get the bounty


I think everyone has made here mistakes, but that is not the point.
I had a guilty conscience so I started my work and trust in what I was reading here.

The S9 uses an Altera Cyclone V SOC.  This is a dual arm a9 hard core processor so yes, it has tons of CPU power for what it is doing. Smiley

I would like to see a comment from KANO or -CK
I never passed judgement on the GPL violation issue because I never looked at fubly's previous project(s) (but I've heard all about it from Kano.) All I was suggesting was that the S9 driver be ported to master cgminer and inherit the fixes that were put into the S1/2/3 drivers - diff up what changes went from S3 to S9 and work that way instead of porting the core cgminer code to their fork. The issue with bitmain's fork is both the core cgminer code and their driver. High CPU usage, throwing away shares, getting best share wrong, massive wasteful work queues that add to latencies are the things I recall off the top of my head. Unfortunately I don't have the time to do the driver myself so I would welcome anyone from the community doing it; don't think I'm singling out fubly.

As for not working on Kano's ckpool I don't think that's anything to do with fubly's code since he can mine on solo ckpool. His actions may have put him on an IP blacklist for kano.is in the past (which may say something in itself.)

I do understand that Fubly did a mess and violated the GPL and for sure this is not acceptable in any way at all. Fubly would not be any better than Bitmain, but.... Always a but, now when we know that, the BMminer is pure crap, aint a good idea to let some skilled people do the work for the Bounty? When you or KNAO do not have the time to make the drivers, do you think Fubly could do this?
The only thing the community is asking (Quite a job, I know) is to read through the FUBLY firmware a give it a green light, since we would not accept any bull regarding the CGminer 4.9.2 and GPL License and frankly, I do not no crap about where to look  Tongue
It would help all of us that is stuck with Bitmain crap and a violated miner and even make the KANO.IS run as the most effective pool?


-CK showed the right way to do it, now somebody has to be found who does it. Drama-free.
